Woman, part of burglary-drug ring among 16 to plead guilty

A Lehigh County woman, formerly of Nesquehoning, pleaded guilty to her part in a multi-county burglary and drug ring Tuesday in Carbon County court. She was one of 16 to enter a guilty plea before Judge Steven R. Serfass.

Among 12Janet Munoz, 43, of Breinigsville, pleaded guilty to five counts of receiving stolen property. She was among 12 people arrested for taking part in a drug and burglary ring that was operating in Carbon, Lehigh, Northampton and Schuylkill counties. The ring would burglarize homes and businesses and then sell the stolen items at pawn shops. They then used the money to buy drugs for resale in the area. The investigation into the ring was labeled "Operation Golden Dope."Munoz's husband, Frank, was called the ringleader in the operation.Munzo previously entered a plea in the case on Dec. 14, 2011, but on the day of sentencing she moved to withdraw her plea, which was granted.She was originally charged with 28 counts in connection with her part in the operation. In a plea bargain reached with the district attorney's office, the count was reduced to five. She has been cooperating with authorities in the case. Several other defendants in the case have already entered guilty pleas.Also part of the plea agreement, Serfass will impose a county prison term of one day less one year to one day less two years, if he goes along with the agreement.Serfass deferred sentencing until the amount of restitution is determined.At the request of defense attorney Thomas Joachim, Serfass revoked her bail and reset it at $50,000 straight cash. Joachim said his client wanted to begin her jail term now so she gets credit at the time of sentencing. She was immediately remanded to the county prison.Other pleasOther defendants who entered pleas included:Christopher Wayne Warner, 23, of Lansford, pleaded guilty in three pending cases all involving entering vehicles and removing various items. The incidents occurred in Lehighton and Palmerton.He pleaded to two counts of criminal conspiracy-theft from a vehicle and one count of theft. He was charged by Palmerton police for an incident on April 3, 2010, in the 200 block of Lafayette Avenue. Police responded to the area to a report of vehicles being entered. Warner was caught near the scene with some of the stolen items.He was also charged by Lehighton police for similar incidents that occurred on the same date, but earlier in the day.Warner was previously placed in the county's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders but was revoked for not completing all the conditions.Serfass placed him on probation for a total of two and a half years and ordered he make restitution of over $930, and render total community service of 125 hours.Kevin J Kassak, 27, of Lansford, pleaded in two pending cases. He pleaded to one count each of theft and receiving stolen property. He was charged by Coaldale police for entering Pappy's Mini Mart on Feb. 21, 2011, and by Summit Hill police for entering the Switchback Valero station on Feb. 20. The Coaldale case was transferred to Carbon with agreement of Schuylkill County authorities.On the Summit Hill case Serfass placed him on probation for 18 months and ordered he get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, zero tolerance imposed on D&A use, and render 25 hours of community serice.On the Coaldale case he was sentenced to the same term consecutive to each other. He was also ordered to make restitution of $1,322 in the Coaldale case. In Summit Hill case restitution totals $1,238.81 of which he is responsible for half.Gary R. Degennaro, 54, of Levittown, pleaded to one count each of driving under the influence (DUI) and driving while under suspension-DUI related. He was arrested on Aug. 5, 2011, along Mauch Chunk St., in Mahoning Township. Given a test, the result showed the presence of a controlled substance.On the DUI count he was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service.On the suspension count he was sentenced to serve 90 days in jail and a fine of $1,000. The jail terms run concurrently.He will begin the jail term on Sept. 11 at 9 a.m. in the Bucks County prison.Following the sentencing a probation revocation hearing was on a petition filed by the adult probation office that Degennaro violated his probation by getting charged with DUI. Serfass resentenced him to serve 30 days in jail, consecutive to the other terms.Steven Michael Fisher, 22, of Weissport, pleaded to one count each of access device fraud and receiving stolen property. He admitted his part in taking the credit card of Martha Zulic and using it at locations in Lehighton. He was identified by surveillance cameras at two of the locations.Serfass placed him on probation for a year on the fraud count and six months on the receiving charge, running consecutively. He was also ordered to get a D&A evaluation, make restitution of $232, of which he must pay half, and render 75 hours of community service.Scott Douglas Brickler, 34, of Dalton, pleaded to one count of receiving stolen property. He was arrested and charged in the same incidents with Fisher. Fisher was the one who accessed the card.He was placed on probation for six months and ordered to make resitution of $232, of which he must pay half, and render 25 hours of community service.Morgan Milkovits, 20, of Palmerton, pleaded in three pending cases, with two others dropped, but restitution owed in all. He was charged with entering vehicles and removing various items. He pleaded to two counts each of theft and receiving stolen property.He was placed on probation for a total of four years and ordered to make total restitution of $1,199.38, and render 125 hours of community service.Joseph Tate, 49, of Palmerton, pleaded to one count of possession with intent to deliver a controlled substance-heroin.He was arrested by agents of the state Attorney General's office for making at least six sales to an undercover agent at locations in Palmerton and Allentown. He sold a total of 117 bags of heroin to the agent. The plea was to one of the sales.Serfass deferred sentencing to a later date.Joshua Bierman, 29, of Jim Thorpe, pleaded to one count of simple assault. He was arrested on July 4, at Kemmerer Park on Packer Hill in Jim Thorpe, where he admitted assaulting his ex-girlfriend, Christy Bulla.He said he was high of drugs at the time. He was also on probation at the time.Serfass placed him on probation for two years and ordered him to attend and complete anger managerment counseling, get both a D&A and mental health evaluations, and render 100 hours of community service.Irvin C. Rothenberg, 58, of Dover, Del., pleaded to one count of DUI. He was arrested on July 1 along the turnpike in Kidder Township by state police at Pocono. Given a test, the result was .28BAC.He was placed on probation for six months and ordered to pay a fine of $300, get a D&A evaluation, and render 25 hours of community service.Christy Petruska-Bulla, 36, of Jim Thorpe, pleaded to one count of bad check. She was arrested by Lehighton police on Aug. 19, 2011, for issuing a bad check to the Lehighton Animal Hospital.She was placed on probation for 18 months and ordered to make resitution to the victim for $854.75, and render 75 hours of community service.Phillip John Mcardle, 22, of Jim Thorpe, pleaded to one count of possession of drug paraphernalia. He was arrested on June 16, 2011, by Palmerton police in the area of 537 Delaware Ave. He was previously placed in the ARD program but was revoked for failure to complete all conditions.Serfass placed him on probation for six months and ordered he get a D&A evaluation, zero tolerance imposed on D&A use, and render 25 hours of community service.Michael L. Jones, 53, of Weissport, pleaded to one count each of simple assault, and public drunkenness, as a summary offense. He was arrested on June 8, along Bridge St., in Weissport by state police at Lehighton. During the arrest Jones assaulted Cpl. Shawn Noonan. Noonan did not suffer any injuries.He was placed on probation for 24 months and ordered to get both a D&A and mental health evalutions, and render 100 hours of community service.On the summary charge he was fined $300 and costs.Amanda Danielle Parisi, 25, of Lehighton, pleaded to two summary motor vehicle violations - windshield obstruction and general lighting required. A charge of possession of a small amount of marijuana was dropped in a plea agreement.She was arrested on Sept. 21, 2011, along at S. Second and Iron sts., in Lehighton.Serfass imposed a total of $50 and fines.Troy D. Dubois, 41, of Lehighton, pleaded to one count of DUI. He was arrested on March 11 along N. First St., in Lehighton, by state police at Lehighton. Given a test, the result was .10BAC.Serfass placed him on probation for six months and ordered he pay a fine of $300, get a D&A evaluation, and render 25 hours of community service.It was noted that Dubois has another DUI charge pending.Thomas Patrick Livziey, 27, of Bloomsburg, pleaded to one count of DUI. He was arrested on July 17, 2011, along Broad St., in Beaver Meadows. Given a test, the result was .28BAC.Serfasss sentenced him to serve 10 days to 24 months in prison, a fine of $500, one year license suspension, and render 100 hours of community service.He was given credit for spending eight months in a Salvation Army inpatient program in Wilkes-Barre and immediately paroled.Each defendant sentenced must pay court costs, which average about $1,000, and pay a $50 per month supervision fee while on proation or parole.
