Four defendants removed from ARD program

Senior Judge D. Michael Stine removed four defendants from the ARD (Accelerated Rehabilitated Disposition) Program, which is a probation program for first offenders who committed non-violent crimes and its purpose is to allow them to work off their criminal record to clear their name. Hearings were held Thursday in the Schuylkill County Court and their cases now are placed back on the district attorney's trial list.

Leonard E. Rehatchek, III, 22, of 219 Stock Street, Nesquehoning, violated four rules, failed to report regularly to his probation officer, failed to keep up payments of his fines and costs, failed to complete counseling services and failed to enter a rehab program. He was placed in the program January 20, 2011. He now must face trial for a dui (driving under the influence) charge.Adam David Wilhelm, 28, Pine Grove, violated four rules, did not make timely calls to his probation officer, got arrested again, possessed illegal drugs and failed a drug test. He now must face trial on five counts of theft from motor vehicles parked in Pottsville.Kevin Anthony Kegolis, 26, Shenandoah, violated one rule, he got arrested again and now faces trial on a dui charge.Joshua Wayne Yeagley, 20, Pine Grove, violated six rules, failed to report regularly to his probation officer, failed to get permission to change his address, possessed illegal drugs, failed to keep up with his fines and costs payments, failed to submit to drug and alcohol evaluations and failed to perform community service and now faces trial on a charge of retail theft.One defendant was removed from a regular probation program by Judge Stine.Rudy G. Rudloff, 34, Saint Clar, violated two rules, he was arrested while on probation and had illegal drugs in his possession. He had pleaded guilty to a dui charge on August 14, 2008 and after spending a year in the county prison was released on probation for five years. His 823 days of liberty were taken away and added to his maximum sentence and he was committed to prison to serve out the balance of his term.Summary appealsMatthew McIntosh, 21, of Carthage, New York, lost his appeal from a summary conviction of a motor vehicle code violation as ruled by a magisterial district justice. After a hearing Judge John E. Domalakes found him guilty of racing on a highway and imposed a fine of $300 and costs. McIntosh was cited by a state trooper on Interstate Route 81 in Frailey Township.Mark D. Rose, 34, Tremont, lost his appeal and was ordered by Judge Domalakes to pay the fine and costs imposed by the district justice. He was charged with disorderly conduct for engaging in a a fight over money at Sweet Arrow Lake Park last June.Enter guilty pleasThomas J. Gilliland, Stroudsburg, pleaded guilty to criminal trespass at an apartment at 311 Lafayette Street,Tamaqua, rented by Samantha Needly and Gary Fyrzymalski and was sentenced by Judge Cyrus Palmer Dolbin to serve 12 months on probation, pay $50 to Criminal Justice Enhancement Account and a $50 fee for each month on probation. He was cited by Patrolman Matthew Bynon, Tamaqua Police.Mohamed Soumah, 30, Reading, pleaded guilty to possession of a controlled substance when stopped in Pottsville and was given credit by Judge John E. Domalakes for spending 41 days in the county prison and released on parole for 12 months, pay a fine of $50, pay a $50 monthly probation fee and make restitution of $113 to Bethlehem Regional Lab.Jonathan E. Jacome, 21, West Hazleton, pleaded guilty to possession of drug paraphernalia as charged by McAdoo Police and was sentenced by Judge Domalakes to serve 12 months on probation, pay a $50 probation fee and make restitution of $176 to Bethlehem Regional Lab.
