A Mahoning Township man waived a hearing last week on charges he possessed marijuana and resisted arrest.

Besides allegedly having marijuana and reportedly trying to break free from the custody of police officers, the man also is accused of causing damage to the commode in the Lehighton Police Station detaining cell.The defendant is Randy J. Whiteman Jr., 31, of Lower Nis Hollow Drive.The charges were filed by Lehighton Police following incidents at 191 S. First St., Lehighton, and then at the former police station in the Municipal Building.Whiteman has been charged with criminal trespass, unlawful possession of a controlled substance (cocaine), possession or delivery of a small amount of marijuana, possession of drug paraphernalia, and resisting arrest.Police reported there's a possibility additional charges might be filed.He was scheduled to have a hearing before District Judge Edward M. Lewis of Jim Thorpe but opted to waive the charges to Carbon County Court.The charges stem from an incident on Friday, June 10, at 11:20 p.m.Sgt. Joseph C. Lawrence, the investigating officer, writes in his affidavit that he was dispatched by the Carbon County Telecommunications Center to South First Street where there was a fight involving two males.At the scene, Whiteman allegedly told police he was assaulted by another individual.Lawrence says in the affidavit that he questioned the other individual, who said Whiteman came to his residence. When the second individual met him at the door, Whiteman "grabbed him around the head and pushed him to the sidewalk," according to the affidavit.A neighbor reportedly to police that the defendant entered the front yard of a property. In the affidavit, the neighbor said "Whiteman emptied his pockets and threw the items to the ground along the fence. There was a buck knife, a glass marijuana bong, a prescription container which had a small clear plastic baggie which contained green vegetable matter. There was another prescription container which had the defendant's name on it..."Sgt. Lawrence says in the affidavit that after transporting Whiteman to the police station, Whiteman provided a voluntary written statement.The police sergeant adds, "I was attempting to escort him to the cell area, in order to call the DA (district attorney) concerning this incident and the defendant attempted to turn left in the hallway, toward the front door as to leave the building instead of turning right toward the cell area. He attempted to push his way past me. Myself and officer Derek Solt had to employ means justifying or requiring substantial force to overcome his resistance in order to secure him inside the cell."Police said material confiscated during the incident tested positive as cocaine and marijuana.
