Ten area residents among 42 to enter guilty pleas

Ten area residents were among 42 who entered guilty pleas to criminal charges in Schuylkill County court and were sentenced by Judge John E. Domalakes as follows:

James H. Smith, 63, of 11 Walnut St., Barnesville, on two counts of driving under the influence (DUI) was sentenced to serve two to 10 years in a state correctional institution. He was ordered to report to the county sheriff's office for transportation to the state facility on Saturday, July 16. at 9 a. m.Smith also must pay $3,500 in fines, $600 to Substance Abuse Education (SAE) fund, $100 to Catastrophe fund, $120 to Schuylkill Medical Center, receive intensive substance abuse treatment and his driver's license is suspended 18 months. On two counts of driving while his license was suspended was fined $2,000 and given an odd sentence which included imprisonment of 89 days, 23 hours, 59 minutes and 59 seconds to 90 days on two charges of driving while his operating privileges were suspended, to run concurrent with the DUI sentence. On two charges of striking parked cars on North Greenwood Street, Tamaqua, was fined $600 plus costs.Smith was cited by Tamaqua Patrolman David Mattson, and by Trooper Michael D. Marinchak in Mahanoy City. When his driving privileges are restored he must install an ignition interlock in his car for 12 months.Keith A. Washeim, 40, of 212 S. Centre St., Tamaqua, dui, sentenced to serve one to five years in a state correctional institution on a DUI charge. He was ordered to report to the county sheriff on Tuesday, July 5, at 9 a.m. to be transported to a state facility. Washeim also was fined $1,500, pay $100 to SAE fund, $50 to Catastrophe fund, $60 to Schuylkill Medical Center, receive intensive outpatient counseling and his driver's license is suspended 18 months.On a charge of driving while his license was suspended was fined $500 and given a concurrent 60 days sentence. When he is allowed to resume driving he must install an interlock ignition device on his car for 12 months. Washeim was cited by Rush Township Patrolman Richard Bekesy.Joseph Stephen Terry, 46, of 151 Third St., Coaldale, on a DUI charge was sentenced to serve 72 hours to six months in the county prison beginning Tuesday, July 12, at 9 a.m. and may participate in work release program, pay a fine of $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, complete alcohol highway safety school, receive outpatient substance abuse treatment and driver's license suspended 12 months.On a charge of failing to have lights on during required driving period was fined $25 plus $50 costs. Terry was cited by Coaldale Patrolman Charles Blesse.Angelo Vincent Antonucci, 24, of 177 Stock St., Nesquehoning, possession of a controlled substance (CS), placed on probation 12 months, pay $100 to SAE fund, $50 to Criminal Justice Enhancement Account (CJEA), and make restitution of $113 to Bethlehem Regional Lab. Antonucci was cited by Shenandoah Capt. George Carado.Kevin Oscar Leibensperger, 47, of 526 Washington St., Tamaqua, DUI, was sentenced to serve 72 hours to six months in the county prison beginning Friday, July 8, at 9 a.m., fined $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, complete safety school and intensive outpatient treatment and license suspended 12 months. He was cited by Rush Patrolman Corey Herring. On a charge of stalking cited by Tamaqua Patrolman Karl Harig II, was sentenced to serve an additional 18 months on probation.Valerie K. Nattress, 30, of 229 Cedar St., Tamaqua, resisting arrest, received credit for serving 22 days in the county prison and was released on parole for 18 months, pay $50 to CJEA, and undergo a mental health evaluation. Nattress was cited by Tamaqua Patrolman Thomas Rodgers.Rebecca Keefer, 26, of 47 Fourth St., Kelayres, attempting to pass a forged check at Walmart Store, Rush Township, was placed on probation 36 months, pay $50 to CJEA and make restitution of $164.24 to the store. She was cited by Kline Township Chief John Petrilla. Keefer also pleaded guilty to retail theft at the store and was given a concurrent probation sentence of 23 months, pay $50 to CJEA and make restitution of $308.37 to the store. She was cited by Rush Cpl. Duane Frederick.Andrew John Bobey Jr., 47, of 14 N. Hancock St., McAdoo, DUI, entered the county prison last Friday at 9 a.m. to begin a 72 hour sentence and was to be released on parole for six months after completing his minimum sentence. He also was fined $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, complete safety school and intensive outpatient substance abuse counseling and his license was suspended 12 months. Bobey was cited by McAdoo Patrolman Joseph David.John L. Kingston Jr., 25, Shenandoah, assaulting Michele Hornberger, 30 Laurel St., Shenandoah, was given credit for serving 93 days in the county prison and was released on probation for 23 months, pay a fine of $50, and pay $50 to CJEA. He also was ordered to continue and successfully complete Batterer's Program. Kingston was cited by Shenandoah Patrolman Robert Senape.George Petrylak III, 38, Shenandoah, aggravated assault on William J. Pesavage and Stacey Marie Fonsick at 148 Mount Olive Boulevard, West Mahanoy Township, two counts of recklessly endangering the couple by firing a rifle in the room they were with the bullet lodging in the roof of the porch and one count of terroristic threats, was sentenced to serve 18 to 36 months in a state correctional institution with credit for serving 206 days in the county prison and pay $50 to CJEA. Petrylak was cited by Trooper Edward Lizeweski.Karen Battistini-Arizmendi, 26, Reading, possession with intent to deliver a CS was sentenced to serve 15 days to 23 months in the county prison beginning Wednesday, July 6, at 9 a.m., pay $50 to CJEA, $100 to SAE fund, and make restitution of $113 to Bethlehem Regional Lab. She was cited by Trooper Brian Walters at the entrance to the state correctional institution in Ryan Township. Marijuana was found in her car.Jonathan R. Bowers, 22, Saint Clair, retail theft from Walmart Store in Saint Clair was placed on probation 12 months, pay $50 to CJEA, and make restitution of $16.84 to the store.Robert Benjamin Bowers III, 23, Pottsville, on a charge of assaulting Tyler John Frantz, Mechanicsville, was sentenced to serve 18 months on probation, pay $50 to CJEA, and make restitution of $2,486.25. Bowers was cited by Port Carbon Chief Jon J. Bowman.Heather Louann Donati, 39, Pottsville, public drunkenness, was fined $300 and pay $50 to CJEA. Donati was cited by Saint Clair Chief Michael P. Stevens, 35, Shenandoah, on a DUI charge began serving a sentence of 72 hours to six months in the county prison last Friday at 8 a.m. and granted immediate parole on completion of her minimum sentence, fined $1,000, pay $100 to SAE fund, $50 to Catastrophe fund, $60 to Schuylkill Medical Center, complete safety school and intensive outpatient counseling and license suspended 12 months.On a charge of possession of drug paraphernalia must serve an additional 12 months on probation. Stevens must also submit to random screens and continue with self-help recovery group and undergo drug and alcohol evaluation. On a charge of possession of drug paraphernalia must serve an additional 12 months on probation. George was cited by the Schuylkill County Drug Task Force.David Gerard Hudack, 45, Sugarloaf, DUI, entered county prison last Friday to begin serving a sentence of five days to six months and will get immediate parole when minimum sentence is completed, fined $300, pay $100 to SAE fund, $50 to Catastrophe fund, complete safety school and intensive substance abuse outpatient treatment and license suspended 12 months. When allowed to drive again must install ignition interlock device on car for 12 months.
