Ten first-time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program recently by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete the program, or is revoked from it, the Commonwealth reserves the right to prosecute them on all pending charges. A person does not admit guilt in entering the program.All were placed for a year, unless otherwise noted.Patricia Ann DeMarco, 46, of White Haven, was placed on a charge of driving under the influence (DUI) of alcohol. She was arrested on Oct. 30, 2010, along SR940 by Kidder Township police. She refused a blood test and will lose her license for a year for the refusal.Serfass ordered her to pay $450 for the cost of the program, get a drug and alcohol (D&IA) evaluation and follow any recommendation for treatment, and her license was suspended for an additional 60 days.Shawn P. Kerr, 23, of Hazleton, was placed on a charge of DUI of a controlled substance. He was arrested along Broad St., in Beaver Meadows, by borough police. A test revealed a controlled substance in his system.Serfass ordered he pay $450 for the program, get a D&A evaluation, license suspended for 60 days and must render three hours of community service per month while in the program.Joseph A. Labarbera, 25, of Montrose, Susquehanna County, was placed on a DUI charge. He was arrested on Feb. 21 along SR940 by Kidder Township police. Given a test, the result was .21BAC.Serfass ordered he pay $450 for the program, get a D&A evaluation and his license was suspended for 60 days.William Henry O'Rourke, 47, of Mountain Top, was placed for two years on a fleeing and attempting to elude police and DUI charges. He was arrested on Nov. 5, 2010, along SR209 in Nesquehoning. No BAC test was reported.Serfass ordered him to pay $450 for the program, get both D&A and mental health evaluations, and his license was suspended for 60 days.Jose R. Peralta, 19, of Hazleton, was placed on a charge of DUI. He was arrested on Feb. 12 along Broad St., in Beaver Meadows, by borough police. Given a test, it revealed the presence of a controlled substance.Serfass ordered him to pay $450 for the program, get a D&A evaluation, license suspended for 60 days and render three hours of community service per month while in the program.Nathan David Pfeiffer, 19, of Weatherly, was placed for 18 months on a DUI charge. He was arrested on Dec. 18, 2010, along Buck Mountain Road in Lausanne Township, by state police at Hazleton. Given a test, the result was .11BAC.Serfass ordered he pay $450 for the program, get a D&A evaluation and his license suspended for 90 days because he is under the age of 21.Anthony Sandefer, 21, of Weatherly, was placed on a charge of possession of marijuana. He was arrested on Oct. 20, 2010, at his residence by borough police.Serfass ordered he pay $350 for the program, get a D&A evaluation and render 15 hours of community service.David J. Sartori, 24, of White Haven, was placed on a DUI charge. He was arrested on Feb. 9 along SR940 by Kidder Township police. Given a test, the result was .26BAC.Serfass ordered he pay $450 for the program, get a D&A evaluation, and his license suspended for 60 days.Michael James Wetzel, 47, of Lansford, ws placed on a charge of DUI. He was arrested on Aug. 8, 2010, along Abbott St., in Lansford. She was arrested on Feb. 27 along the northeast extension of the turnpike in Kidder Township by state police at Pocono. Given a test, the result was .25BAC.Serfass ordered her to pay $450 for the program, get a D&A evaluation and license suspended for 60 days.All defendants must pay court cost, which average over $1,000, and a $50 per month supervision fee while in the program.
