Thomas J. Adamitis, 406 Pitt St., Apt. 206, Tamaqua, filed a civil action against Michelle Hermany, last known address, 255 Lafayette St., Tamaqua, alleging her vehicle struck him and he suffered injuries.The suit states on Nov. 14, 2009, around 6:30 p. m. Adamitis was a pedestrian walking at or near 99 Rower Street and a vehicle operated by Hermany suddenly and without warning struck him. Yelito, 301 Green St., Tamaqua, for failure to keep up mortgage payments.Two car accidentLauren Schock-Wall and husband, Jesse Wall, filed a civil action against Draper and Yost Inc., Tamaqua, and Barry Heckman, 34 Spring St,, Weatherly, for injuries suffered by Lauren Shock-Wall and damages to her vehcle from an accident which occurred on Nov. 3, 2008, on SR54 in Hometown, Rush Township, with vehicles driven by Lauren Schock-Wall and Heckman, who was operating a vehicle owned by Draper and Yost. The wife and husband are each seeking damages in excess of $50,000.File for divorceEdward A. Folk filed an action for divorce from Tiffany Marie Folk, both of 25 E. Schmaltzdahl Road, New Ringgold. They were married Aug. 23, 2008.SentencedDevin Wendal Murphy, 17, Pottsville, who was found guilty buy a jury of simple assault, was sentenced by President Judge William E. Baldwin to be placed on probation for 23 months as he had already spent 116 days in the county prison. He also shall make restitution of $390 to Bryan Shipton, the victim, and have no contact with him, undergo a mental health evaluation, enroll in Anger Management classes, shall not remain on grounds of Pottsville Area School District or any school district after being dismissed from classes at the end of each day and he shall not participate in or attend any extra curricular activities at any school. The assault took place while Murphy was a junior at high school with another student.Leonard Charles Radziewicz, 44, Pittsburgh, who pleaded guilty last Oct. 21 to driving under the influence (DUI) of alcohol in Pottsville on July 29, 2009, was sentenced by President Judge William E. Baldwin to serve 30 days in the county prison with credit for serving 24 days, and when released is placed in the Intermediate Punishiment Program (IPP) to serve a probation period of four years and 11 months under supervision of Alleghany County Probation Department, pay a fine of $1,500 and court costs, pay $300 to the Substance Abuse Education fund, $100 to the Catastrophe fund, $60 to Schuylkill Medical Center, driver's license suspended 18 months and when restored for 12 months must have an ignition interlock on his car.Revoke probationsStephen M. Gaughan, 24, Shenandoah, had his probation revoked by Judge D. Michael Stine and he was recommitted to the county prison for the balance of his sentence and his 121 days of liberty were taken awary and added to his sentence. He received credit for serving 65 days in prison. Gaughan pleaded guilty last Feb. 25 selling drugs from his home and after serving a prison sentence was released on probation for two years.Jaclyn Marie Hollywood, 28, Frackville, had his probation revoked by Judge Stine and he was re-sentenced on a criminal cnspiracy to commit retail theft charge to serve two to 23 months in the county prison. He had pleaded guilty to the charge on Nov. 25, 2008, and was placed on probation. The theft was from the Big Lots Store in the Schuylkill Mall.Placed in programJohn Michael Colihan, Girardville, was qualified for the Accelerated Rehabilitation Disposition (ARD) probation program, which is reserved for first offenders to allow them to clear their name of a criminal record.He was placed for 12 months by Judge John E. Domalakes, pay a $350 assessment fee to defray cost of the program, pay $50 to the Criminal Justice Enhancement Account, a $50 monthly supervison fee while in the program.He is charged with recklessly endangering another person filed by Patrolman Peter Wysochansky, Girardville police, following a disturbance on a street in the borough last June 17.Revoke paroleRichard Ray Gettle, 49, Mount Aetna, Berks County, had his parole revoked by Judge Baldwin and he was transferred to the Department of Corrections to be confined at a state correctional facility. Baldwin also relinquished jurisdiction for parole to the state board of probation and parole. He entered a guilty plea to DUI on May 20, 2008, and after serving 90 days in prison was placed on parole for five years. He was cited by Trooper Mario A. Pompei on March 25, 2007, on SR443 in Pine Grove.Summary appealsJudge Charles M. Miller held hearings on appeals filed from sentences imposed on criminal charges by district justices.Evan C. Williams, 57, Pottsville, withdrew his appeal and entered a guilty plea to a charge of speeding on SR61 between Pottsville and Schulylkill Haven last July 30 and was ordered to pay a fine and costs totaling $129.50. He was cited by Trooper Stefen J. Stinksy.Jazzmyn Anastasia McCoy, 20, Pottsville, was found guilty of driving while his operating privileges were suspended and he was ordered to pay fine and costs totaling $289.50. He was cited by Trooper Robert A. Richards last Jan. 31 on SR901 in Cressona.John R. Card, 20, Hazleton, entered pleas to speeding last March 29, on Lincoln Drive, Hometown, and was ordered to pay $147.50 in fines and costs and on a charge of driving while his license was suspended was fined $500 and must serve 60 days in the county prison beginning Nov. 10 at 9:30 a.m.Michael Barone, 51, Excelsior, Northumberland County, pleaded guilty to speeding on Fairground Road in Butler Township last July 29 and must pay $151.50 in fines and costs.James A. Campbell Jr., 37, Shamokin, was found guilty of a harassment charge and was fined $349 and costs.Gale Matthews, 45, Spring Glen, was found guilty of harassment and ordered to pay $199 in fines and costs.Richard J. Ludwig, 37, Ringtown, was found guilty of a charge of careless driving on Hobart Street in Gordon and has to pay $121.50 in fines and costs. He was cited by Patrolman Eric A.Vinskie, Butler Township police, last April 21.Kelly M. Crossan, 24, Media, Delaware County, was found guilty of a charge of driving while her license was suspended when stopped on SR924 at the entrance to Eagle Rock Resorts, East Union Township, last Dec. 5 and has to pay $296.50 in fines and costs.Violate PFA ordersJudge D. Michael Stine found two defendants guilty of indirect criminal contempt for violatng their protection from abuse (PFA) orders. James John Ney, 48, of Pottsville, and Andrei R. Walsh, 22, Orwigsburg, and both have to pay a fine of $300 and costs.
