Brockton man gets probation for driving under the influence

A Brockton man was among seven people who entered guilty pleas to criminal charges and were sentenced recently by Schuylkill County judges.

Kyle John Delpais, 24, of 314 Mine St., Brockton, Schuylkill Township, on a charge of driving under the influence (DUI) of alcohol was sentenced by President Judge William E. Baldwin to be placed on strict probation for six months, pay a fine of $300 and court costs, pay $100 to Substance Abuse Education (SAE) fund, $50 to Criminal Justice Enhancement Account (CJEA) fund, make restitution of $60 to Schuylkill Medical Center, and enroll and complete the alcohol highway safety school. On charges of careless driving and failing to activate his turning signals when required was fined $25 each plus $100 in costs. Delpais was cited by Patrolman Brian W. Kotzmoyer, Pottsville police, last Aug. 12.Rachel Tiere Wherry, 21, Philadelplhia, on a charge of possession of a small amount of marijuana was placed on probation 30 days by Baldwin and ordered to pay a fine of $500 and court costs, pay $100 to SAE fund and $50 to CJEA fund. On charges of driving without a license was fined $200, careless driving, fined $25 and failure to obey a traffic signal fined $25 plus $150 costs. Wherry was cited by Cpl. Mark O'Toole, Pottsville police, on April 13, 2008.Ray Allen Lucas, 24, Tower City, on a charge of DUI was placed by Judge John E. Domalakes on probation six months after receiving credit for spending 13 days in the county prison, pay $100 to SAE fund, $50 to Catastrophe fund, a fine of $1,000, enroll in alcohol highway safety school and undergo intensive outpatient counseling, make restitution of $60 to Schuylkill Medical Center, and his driver's license is suspended 12 months. On summary charges of careless driving and failing to drive on roadway laned for traffic was fined $25 each plus $100 costs. Lucas was cited by Trooper Michael Ryan last Sept. 15 when stopped in Porter Township. On a charge of cashing a check on an account which did not have sufficient funds was sentenced to serve an additional 12 months on probation.Scott A. Wertz, 21, Tremont, on a charge of DUI was sentenced by Judge Jacqueline Russell to serve six months to two years in the county prison, pay a fine of $500 and court costs, pay $100 to SAE fund, $50 to CJEA fund, complete an alcohol safe driving school and intensive outpatient counseling while on probation. On charges of unauthorized use of a motor vehicle and resisitng arrest serve concurring 12 month probations on each charge and make restitution of $300 to Jonathan Lemmon, Pine Grove Township, whose car he took. On the charge of driving while his license is suspended-DUI related, sentenced to serve a concurring 90 days in prison and pay a fine of $1,000. On a charge of reckless driving was fined $200 and costs. The sentence becomes effective Monday, March 22, at 9 a.m. when he is ordered to report to the warden at the prison. Wertz was cited by Trooper Thomas Hornung on Jan. 1, 2009, in Pine Grove Township.Iashe Willliam Thompson, 20, Pottsville, on a charge of receiving stolen property was given credit by Judge Cyrus Palmer Dolbin for serving seven days in the county prison and was released on parole for 23 months, pay a fine of $150, pay $50 to CJEA fund, and make restitution of $1,675 to William Sears. On a second charge of receiving stolen property was fined $100 and make restitution of $280 to Keith Kintzel and serve a concurrent 23 months probation sentence. Thompson was cited by Patrolman Eugene Yourey, Pottsville police, last Sept. 3.Dustin Charles Parsons, 24, Pottsville, on a charge of corruption of minors was sentenced by Baldwin to serve one to 23 months in the county prsion and pay $50 to CJEA fund. On four other counts of corruption received concurrent 12 months probation on each charge and on a charge of selling alcoholic beverages to minors received a concurrent 12 months probation sentence and fined $1,000. Parsons was cited by Patrolman Kirk Becker, Pottsville police, last Aug. 27.Angel Nicole Christ, 19, Port Carbon, on a charge of possession of drug paraphernalia was placed on probation by Baldwin for 12 months, pay $100 to SAE fund and $50 to CJEA fund. Christ was cited by Sgt. James R. Joos, Pottsville police, last July 7.Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
