Probation, parole revocation hearings held

Probation/parole revocation hearings were conduct by Carbon County judges on petitions filed by the adult probation office against defendants for violating the terms of their release.

Lorene Rice, 38, of Palmerton, had her probation revoked on a retail theft charge on a petition filed by probation officer Kimberly Cooper for violating the terms of her release by being arrested by Palmerton police for another retail theft. At the time she was also on probation for another retail theft.Judge Steven R. Serfass resentenced her to serve six to one day less than 24 months in the county prison on three pending cases effective April 1.Stephen Meleschuk, 55, of Whitehall, had his probation revoked on a charge of persistent disorderly conduct on petition of Cooper for violating conditions by testing positive for cocaine and alcohol which violated zero tolerance provision.President Judge Roger N. Nanovic II resentenced him to serve 30 to 60 days in the county prison effective July 28. The order states Meleschuk must serve the entire 60 days.Joshua A. Gross, 20, of Palmerton, had his parole revoked on a charge of theft on petition of Cooper for violating conditions by overdosing on heroin.Judge Joseph J. Matika ordered Gross be remanded to the county prison to serve out his maximum which runs to April 11, 2015. Matika ruled Gross would be eligible for parole if he enters an inpatient rehabilitation facility.Ryan Cebrosky, 22, of Palmerton, had his parole revoked on charges of theft and escape on petition of Cooper for violating conditions by being arrested by Allentown police, violating the zero tolerance provision for alcohol, and not making a concerted effort to pay his court costs.Nanovic resentenced him to serve 90 days back-time in the county prison on each charge, running concurrent and effective Aug. 7.Robert Ruzicka, 23, of Palmerton, had his parole revoked on a driving under the influence charge on petition of Cooper for violating conditions by being arrested by Palmerton police for possession of drugs, by Mahoning Township police for burglary and related counts, testing positive for opiates, overdosing on heroin, admitting taking nonprescribed Xanax, testing positive for alcohol, noncompliant for drug and alcohol treatment, and not completing 25 hours of community service.Serfass resentenced him to serve five months back-time. However, he will serve the time in the Salvation Army inpatient program at Altoona and must successfully complete the program. If he fails to complete the program he must immediately return to the county prison and serve the five months with no credit for inpatient treatment.Brandice Boner, 33, of Nesquehoning, had her parole revoked on a charge of possession of drug paraphernalia on petition of probation officer Clifford Eckhart for violating conditions by being charged with a new criminal offense.Serfass resentenced her to serve four months back-time in the county prison, run consecutively to a prior case. She was given credit for 48 days spent in jail on the charge.Katlin Fronheiser, 23, of Lehighton, had her parole revoked on a charge of receiving stolen property on petition of probation officer Jillian C. McGinley for violating conditions by failing to report to the probation office as directed, having new criminal charges filed against her, and testing positive for nonprescribed suboxone.Matika resentenced her to serve six months back-time effective Aug. 15.Amanda Everitt, 23, of Palmerton, had her placement in the county's Accelerated Rehabilitation Disposition probation program revoked on petition of Cooper for violating conditions by failing to pay court costs in full and failing to perform 50 hours of community service.Serfass ordered the case placed on the next available trial list.Thomas Nodzo, 47, of Albrightsville, had his parole revoked on a driving under the influence charge on petition of probation officer Joseph Bettine for violating conditions by being arrested by state police at Fern Ridge on May 4 for another DUI and other counts.Matika resentenced him to serve 150 days back-time in the county prison effective May 19.Jason Tessitore, 30, of Tamaqua, had his probation revoked on a theft charge on petition of Eckhart for violating conditions by being cited for public drunkenness and disorderly conduct, failed to maintain payments on court costs, and failing to perform 50 hours of community service.Matika resentenced him to serve 45 to 90 days in the county prison with credit for 74 days. However, he must serve the entire balance of his sentence which runs to Nov. 2.Erick Rivera, 23, of Lake Harmony, was revoked from pretrial services on petition of Bettine for violating conditions by testing positive for opiates which violated the zero tolerance provision.Matika reset bail at $10,000 straight cash and remanded Rivera to the county prison when he failed to post the bail.
