Guilty pleas in Carbon County

Defendants entered guilty pleas to various offenses in before Carbon County Judge Joseph J. Matika on Thursday.

Edward T. Thierer, 47, Nesquehoning: Felony charge of retail theft of $1,800 worth of items from the Walmart store in Mahoning Township. Matika deferred sentencing to Sept. 24.Nelson DeJesus, 25, Hazleton: Driving under the influence of marijuana. Matika deferred sentencing. DeJesus was stopped by Nesquehoning police on Nov. 9, 2013. The officer smelled marijuana, and DeJesus' blood showed that he had ingested the drug.Marley C. Guesic, 26, Lansford: Disorderly conduct, driving under the influence and possession of drug paraphernalia, from three different cases. Matika released her on $2,000 unsecured bail and deferred sentencing.Guesic had had a bench warrant against her for failing to appear at a May 21 plea hearing. She explained she had been in a California rehabilitation program, and had made an "honest mistake" in getting the date for the hearing wrong.Matika forgave the bench warrant.Ashley Marasiak, 27, Lehighton: Conspiracy. Matika sentenced her to pay $788 in restitution, serve 12 months probation, and perform 50 hours of community service.Marasiak was charged by Mahoning Township police after trying to cash a fraudulent check at Walmart on June 7, 2013. She told Matika she had fallen in with a bad crowd during a difficult time in her life, and since changed. She works, takes online classes and cares for her son.Michael Zuber, 29, Lansford: Simple assault and public drunkenness. Matika sentenced him to 32 days to 18 months in jail, with credit for the 32 days he's already served, on the assault charge, and fined him $100 for public drunkenness. He also ordered Zuber to undergo a drug and alcohol evaluation, with zero tolerance for any infractions.Zuber was charged June 8 by Lansford police after he was found passed out in a laundromat. When emergency medical technicians were trying to help him, he came to and punched one of them.Zuber told Matika he had been clean and sober since the previous November, but drank too much at a race. He said he had no memory of the incident, and is back on track.Izael Flores, 18, Nesquehoning: Conspiracy to commit robbery. Flores was among six people who robbed two juveniles of a cellphone on Jan. 1. Although a gun was involved, Flores did not have it, his lawyer, Adam Weaver, said. Matika deferred sentencing.Andre S. Hall, 42, Albrightsville: Making false reports and running a red light. Matika sentenced him to one to 12 months in jail, and 100 hours of community service. He also fined him $100 on the traffic signal violation.Hall was charged on Feb. 8, 2014, by Kidder Township police after giving his brother's name to the officer who stopped him.Brian Kieffer, 31, Coaldale: Disorderly conduct. Keiffer was charged on Sept. 26, 2014, by borough police after he was seen getting in the way of traffic while trying to hitch a ride to his sister's house to get his coat.Matika sentenced him to one year on probation and 50 hours of community service.Jay Miller, 22, Lehighton: Simple assault, possession of a controlled substance, and harassment. Miller was charged on June 26 by Mahoning Township police after he assaulted the mother of his child, leaving bruises on her arm."You acted like the south end of a northbound horse that night, didn't you," Matika asked.Miller agreed he had, and said drug abuse was a factor. On the assault charge, Matika sentenced him to one year on probation, 50 hours of community service, and to have no contact with the victim unless it was specifically about their child. He also ordered Miller to have a drug and alcohol evaluation. Matika levied the same sentence for the controlled substance charge, to be served consecutively, and fined Miller $100 for harassment.Samantha Kuntz, 26, Jim Thorpe: Driving under the influence. She was charged on Oct. 4, 2012, after veering into the oncoming lane and hitting another car. She was found to be driving under the influence of morphine and other drugs. She was placed on probation, but that was revoked in May after new charges. Matika deferred sentencing.Michael Williams, 50, Pocono Lake: use/possession of drug paraphernalia. He was charged June 8 by state police at Hazleton after he was found with a crack pipe. Matika sentenced him to six months on probation, and to have a drug and alcohol evaluation.Also on Thursday, Judge Steven Serfass sentenced Jose Enrique Torres Molinary, 34, Bethlehem to 57 days to two days less than 24 months in jail, consecutive to sentences he faces in Monroe and Northampton counties. He also must pay $191 in restitution to Midas Muffler. Serfass gave him credit for the 57 days he's already served.Molinary pleaded guilty to burglary. He required an interpreter, who was paid $50 an hour, with a two-hour minimum, plus mileage.
