First-time offenders placed in probation program
Nine first-time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition program on Tuesday by Judge Steven R. Serfass.
If a person successfully completes all conditions of the program, their record is wiped clean. However, if they fail to complete it, or are revoked from it, then they will face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year, unless otherwise noted.Nancy Leona Butz, 62, of Easton, was placed on a charge of driving under the influence. She was arrested on March 15 by state police at Lehighton along Route 903 in Penn Forest Township. Given a test, the result was 0.08 BAC.She was assessed $450 for the cost of the program and ordered to render 50 hours of community service.Robert Charles Ciaccio, 53, of Saylorsburg, was placed on a DUI charge. He was arrested on Feb. 21 along Bankway by Lehighton police. A test showed 0.17 BAC.He was assessed $550 and ordered to render 50 hours of community service, and his license suspended for 60 days.Edward Robert Dalcero Jr., 40, of Albrightsville, was placed on a DUI charge. He was arrested on Aug. 15, 2014, along Old Stage Road in Albrightsville, Penn Forest Township, by state police at Fern Ridge. A test showed 0.28 BAC.He was assessed $550, ordered to render 50 hours of community service and his license was suspended for 60 days.Robert Thomas Holman, 64, of Albrightsville, was placed on a charge of accidents involving damage to an attended vehicle/property. He was arrested by state police at Fern Ridge on March 6 along Route 903 in Penn Forest Township following a crash.He was assessed $450 and ordered to render 50 hours of community service.John Michael Kelly, 29, of Morrisville, Bucks County, was placed on a DUI charge. He was arrested on Nov. 1, 2014, along Mauch Chunk Street by Mahoning Township police. A test showed the presence of a controlled substance.He was assessed $600, ordered to render 50 hours of community service and his license was suspended for 60 days.Alyssa Marie Magee, 19, of Stroudsburg, was placed on a charge of possession of a controlled substance. She was arrested on March 6 by state police at Hazleton along North Shore Drive in Penn Forest Township.She was assessed $450, ordered to render 50 hours of community service and get a drug and alcohol evaluation and follow any recommendation for treatment.Matthew Charles Althouse, 19, of Bowmanstown, was placed for 18 months on a charge of corruption of a minor. He was arrested on Jan. 17 at Beltzville Lake State Park in Lower Towamensing Township, by park rangers. He was found in a vehicle with others, including a juvenile, with controlled substances.He was assessed $450 and ordered to render 75 hours of community service and get a D&A evaluation.Trevis James Oswarld, 22, of Lehighton, was placed for 18 months on a charge of corruption of a minor. He was arrested in the same incident with Althouse.He was assessed $450 and ordered to render 75 hours of community service and get a D&A evaluation.Joann Faust, 55, of Tamaqua, was placed on a charge of possession of a controlled substance. She was arrested on March 10 by Palmerton police following a traffic stop along Route 248.She was assessed $450 and ordered to render 50 hours of community service and get a D&A evaluation.Joseph A. Gruskin, 26, of Lehighton, was placed on a charge of DUI. He was arrested on July 19, 2014, along Mauch Chunk Road by Palmerton police. A test showed 0.23 BAC.He was assessed $650, ordered to render 50 hours of community service and his license was suspended for 60 days.Each defendant must also pay court costs of about $1,000 and pay a $50 per month supervision fee while in the program.
