Carbon County court

Defendants were sentenced last week after previously pleading guilty in Carbon County court by Judge Joseph J. Matika.

Kevin Todd Clark, 34, of Johnstown, Cambria County, on a count of possession of a controlled substance, was sentenced to serve six to one day less 24 months in the county prison followed by one year of probation.Clark was arrested Feb. 1 by state police at Fern Ridge along Interstate 80 in Kidder Township following a vehicle stop, and marijuana was found in the vehicle.Dylan Brett Danko, 23, of McAdoo, admitted to a burglary charge for his part in the May 15, 2012, entry of a home in Weatherly on the 500 block of Sixth Street. There were three defendants involved in the incident, with Danko the one who actually entered the home. Matika sentenced him to serve six to one day less 24 months in the county prison followed by two years of probation. Matika also ordered him to pay a total restitution of $16,415.78 to the victim,render 100 hours of community service when released on parole, get both drug and alcohol and mental health evaluations, zero tolerance for drug and alcohol use, and supply a DNA sample. The prison term will run concurrent with a sentence he is currently serving in Luzerne County.Brian William Eck, 38, of Summit Hill, who pleaded to one count each of simple assault and recklessly endangering another person was arrested on June 17 by Lansford police for an incident in the 200 block of East Kline Avenue. Officers responded to a report of a domestic incident.Eck's girlfriend told them he had choked her during an argument. Matika sentenced him to time served, 95 days to one year in the county prison, 50 hours of community service, have no contact with the victim, and to have a drug and alcohol evaluation.James Allen Neff, 62, of Weissport, on a count of criminal trespass, was sentenced to time served, 331 days, to one day less two years in prison, render 100 hours of community service, zero tolerance for drug and alcohol use, get a drug and alcohol evaluation, supply a DNA sample, and have no contact with the victim.Dylan Smith, 26, of Palmerton, was sentenced on two counts of possession with intent to deliver a controlled substance-meth, and one count each of driving under the influence, fleeing or attempting to elude police and possession of drug paraphernalia, to serve six months to one day less two years, render 75 hours of community service when released, get a drug and alcohol evaluation, zero tolerance for drug and alcohol use, and supply a DNA sample. On a DUI charge he was sentenced to serve 90 days to five years in jail, a fine of $1,500, one year license suspension and credit for 14 days. The term runs concurrent with the drug charge.Smith was arrested on April 13 when Palmerton police attempted to serve a warrant on him. He left out of a bedroom window and fled on foot for a distance, before being taken into custody. Eight baggies of crystal meth were found on him. He was arrested on the second intent count on Oct. 5, 2015, following a traffic stop by state police at Lehighton, when 50 bags of heroin were found on him. He was also charged with DUI. The paraphernalia count stems from an incident on June 15, 2015, when Palmerton police were investigating a burglary. Smith was found to have paraphernalia.
