A man charged by state police with sexual offenses against a child will serve up to 23 months in the Carbon County Correctional Facility followed by two years of probation.
James C. Smiley II, 55, no address given, was charged by state police Trooper Ryan D. English of the Lehighton barracks with statutory sexual assault; aggravated indecent assault on a child under age 16; corruption of minors; and unlawful sexual contact with a minor.
The charges were for an incident in Bowmanstown on Feb. 1, 2022.
Smiley pleaded guilty to the corruption charge; all remaining charges were dropped in a plea agreement.
Judge John J. Matika sentenced Smiley to the jail term, with credit for the 567 days already served. Matika also ordered Smiley to pay $300 restitution; pay a monthly $50 supervision fee; submit a DNA sample and pay the $250 fee; undergo sexual offender, drug and alcohol and mental health evaluations; and perform 100 hours of community service.
In a separate case, Smiley was charged by English with possession of drug paraphernalia and a controlled substance in Palmerton on Sept. 28, 2022.
He pleaded guilty to the paraphernalia charge; the remaining charge was dismissed.
In that case, Matika sentenced Smiley to serve one year of probation; pay a monthly $50 supervision fee; undergo a drug and alcohol evaluation; and perform 50 hours of community service.
