Albrightsville man waives charges in fight
An Albrightsville man has waived charges after a fight with his stepson over the family dog.
According to an affidavit by Trooper Richard Balderrama of the Pennsylvania State Police, Fern Ridge barracks, Daniel Barnes, 50, was involved in the incident on Feb. 25 at a home on Mindy Lane, Penn Forest Township.
Balderrama responded at 5:04 p.m. to a report of a domestic dispute.
The stepson said he and his stepfather fought over the family dog when he attempted to leave with it, believing it belonged to him.
According to the stepson, Barnes locked the dog in his upstairs bedroom. When the stepson tried to retrieve it, a struggle ensued, and they both fell to the floor.
The man said Barnes placed his forearm around his neck, restricting his breathing. In response, the man bit Barnes’ arm to break free before calling 911.
Barnes provided a different account, stating the argument began over a damaged remote control. He admitted locking the dog in his bedroom and holding the door shut when the stepson tried to force it open.
Barnes claimed the man bit him during the struggle, causing the door to open slightly, leading to both falling.
He denied applying pressure to the victim’s neck, saying he was only trying to restrain him.
Barnes was taken into custody and transported to the Fern Ridge barracks, where charges were processed.
Assistant District Attorney Joseph Perilli approved the charges, which include strangulation, simple assault and harassment.
Barnes was released on $20,000 unsecured bail. He waived charges Wednesday before District Judge Eric M. Schrantz in Jim Thorpe.
