Man who violated terms of Megan's law gets prison term

A Carbon County man was given a county prison term on Tuesday after admitting he violated the provisions of Megan's Law after being determined to be a sexual violent predator.

Darryl Jay Ahner, 52, of Lehighton, pleaded guilty before Judge Steven R. Serfass to one count of failure to comply with counseling as required under Megan's Law.On Feb. 8, 2008, Ahner was sentenced by President Judge Roger N. Nanovic to serve 36 to 96 months in a state correctional institution for sexually assaulting a then 4-year-old boy over an eight-month period.Before the sentencing Nanovic determined that Ahner was a sexual violent predator under Megan's Law and had to register as a sexual offender for life and had to follow all mandates of the law, including continuing sexual offenders counseling.Ahner failed to attend any counseling sessions following his release on parole.Tuesday he told Serfass that the counseling sessions were "pricey" and that there were none available in Carbon County and he would have to go to the Lehigh Valley area, and he had no means of transportation.Serfass said he understood the situation about finding proper counseling sessions, but that the law was written because of the seriousness of the crime.Serfass also rejected a request from defense attorney Jennifer Rapa to sentence at the low end of the sentencing guidelines of six months.Serfass said he saw no reason to deviate from the guidelines.Serfass then sentenced Ahner to serve nine to one day less 24 months in the county prison and ordered he render 100 hours of community service when released on parole.He began the jail term immediately.
