A Hazleton area contractor has run afoul of the Pennsylvania Department of Environmental Protection for illegally dumping and burning solid waste on his parents' property.
DEP's Northeast Regional Office received numerous complaints concerning possible illegal dumping at a property in Carbon County.The property, located at the end of Centtown Road in Banks Township, is owned by James and Esther Umbriac.Officials visited the Umbriac property on April 15 and found a large amount of construction and demolition waste, household waste and waste packaging from the processing of ice melt product on the ground's surface.They also found a freshly covered burn area, still smoldering, and areas of partially buried debris.They spoke with Joseph Umbriac, James and Esther's son, who admitted dumping waste, then reloading it into larger waste transportation vehicles, as well as burning some of the waste, including plastic containers.The Umbriacs did not have a permit allowing such action.DEP issued a noncompliance order against Umbriac, listing violations of nine sections of the Pennsylvania Solid Waste Management Act.He was ordered to immediately cease and desist such dumping/burning and take corrective action.He was given 45 days to legally dispose of the waste at the site and was ordered to provide receipts to prove to DEP that he legally disposed of the items.Joseph Umbriac was cited for the very same violations in May 2012.That dumping was done on property in Hazle Township, Luzerne County.He has 30 days to appeal the noncompliance order.
