A Carbon County woman came to the county court on Thursday to enter a plea to a driving under the influence charge. Instead of pleading, she ended up in the county prison.
Michelle Helen Rafalko, 49, of Lehighton, was supposed to plea to the DUI count, but court personnel detected the odor of alcohol on her when she appeared for her plea proceeding before Judge Steven R. Serfass.The adult probation office had her take a portable breath test, which revealed a 0.09 BAC.Rafalko told Serfass she was "nervous" and "I have a problem with alcohol."She also admitted drinking two glasses of wine before coming to court.It was noted she did not drive to court, but was brought by a relative.Serfass said coming to court under the influence of alcohol is being disrespectful to the court.He found her in contempt of court and ordered the sheriff's department to take her into custody and placed in the county prison in Nesquehoning overnight.Serfass also ordered the sheriff's department to being Rafalko to his court on Friday at 9 a.m. for her guilty plea.
