A referendum question on the ballot concerning the retirement ages of judges will not count.

The question asks voters if they favor increasing the mandatory retirement age from 70 to 75.Last week, Commonwealth Court Judge Kevin Brobson's upheld a state resolution calling for delaying the vote from the primary election to the general election.Because of the lateness of the ruling, voters will still be able to vote on the referendum because election bureaus did not have sufficient time to remove the question from the ballot.Regardless of the ruling, the question is likely to be a barometer for the future results of the question.In Carbon County, the three judges are years away from the retirement age. President Judge Roger Nanovic, who joined the judiciary in 2002, won't turn 70 until Aug. 13, 2024. Judge Steven Serfass will turn 70 on Oct. 14, 2039. He became a judge in 2010. Judge Joseph J. Matika, who is only in his fifth year on the bench (since 2012) will turn 70 on April 5, 2032.
