A Carbon County woman, who appeared in the county court last Thursday to plead guilty to driving under the influence, only to end up in the county prison when it was determined she was under the influence of alcohol, finally got to enter the plea on Friday.
Michelle Helen Rafalko, 49, of Lehighton pleaded to one count of DUI before Judge Steven R. Serfass.Rafalko was scheduled to enter the plea but when she arrived at the courthouse for the plea proceeding court personnel detected the odor of an alcoholic beverage on her. The adult probation office had her submit to a breath test, which revealed a 0.09 BAC.She then appeared before Serfass and admitted drinking two glasses of wine before coming to court.Serfass said her actions were disrespectful to the court and ordered the sheriff's department to take her into custody and place her in the county prison overnight.Friday morning she entered the plea but sentencing was deferred when Serfass was told Rafalko had made arrangements to enter a inpatient rehabilitation facility in New Jersey within 72 hours of herplea.She was arrested on July 25, 2014, along Second Street by Lehighton police after a hit-and-run accident. A test showed 0.30 BAC.
