Carbon County court — ARD

Four people charged with criminal counts were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program for first-time offenders on Aug. 17 by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

Placed were:

Justin Tyler Mazzella, 28, of Albrightsville, was placed for two years on a charge of felony aggravated assault-attempt to cause serious bodily injury or causes injury with extreme indifference and related counts.

He was arrested on Jan. 4, 2020, by state police at Fern Ridge for an incident at Valesio’s Pizzeria along Route 903 in Penn Forest Township. Troopers responded to a report of a fight in progress. The police report indicated Mazzella struck the victim with a glass object and the fight was among rival groups.

Serfass questioned the placement due to incomplete information concerning the victim. The court was told the victim agreed to the ARD placement at the preliminary hearing held in the matter. It was also noted that the victim did not respond to requests from the district attorney’s office concerning medical bills.

Mazzella was ordered to pay an assessment of $650 for the cost of the program, render 100 hours of community service and have no contact with the victim.

Robert Cerobski, 34, of Brooklyn, New York, was placed for two years on a charge of criminal trespass - break into a structure, and related counts. He was arrested by state police at Fern Ridge on April 9 at a residence along Park Trail in Albrightsville.

He was assessed $450 and ordered to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, attend and successfully complete an anger management course and render 100 hours of community service.

Theresa Maria Cuth, 51, of Walnutport, was placed for a year on a driving under the influence charge. She was arrested on Sept. 5, 2020, by state police at Lehighton along Maury Road in Penn Forest Township. She refused any testing.

She was assessed $650 and ordered to render 50 hours of community service and her license was suspended for 60 days.

Mary Ann Van Lieu, 64, of Lansford, was placed for a year on a charge of fraud to obtain food stamps. She was charged by the Office of the State Inspector with receiving food stamps when she was not eligible.

She was assessed $450 and ordered to render 50 hours of community service and make restitution to the state for $996.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
