Carbon County court — guilty pleas
Thirteen defendants in pending criminal cases entered guilty pleas in Carbon County court on Monday during a daylong session.
President Judge Roger N. Nanovic II accept pleas from the following:
Dakota Woodard, 24, of Lansford, pleaded to one count each of possession of a prohibitive offensive weapon and resisting arrest. He was arrested on Feb. 13 by Nesquehoning police along East Catawissa Street. Police were in the area looking for a person involved in an altercation and Woodard fit a description given to police. While attempting to take him into custody he fought with the officers and had to be taken to the ground and handcuffed.
Sentencing was deferred so Woodard can apply for the house arrest program.
Joseph James Forster II, 53, of Tamaqua, pleaded to one count of possession of a controlled substance. He was arrested on Dec. 4, 2019, by Lansford police at the county prison. He was brought to the prison and drugs found. A felony count of contraband into the prison was dropped in a plea deal with the district attorney’s office.
Sentencing was deferred and the adult probation office was ordered to prepare a presentence investigation report. It was noted he has a pending drug case.
Deanna Augelli, 42, of Lansford, pleaded to one count of simple assault with a felony count of aggravated assault dropped in a plea deal. She was arrested on Dec. 12, 2020, by Lansford police along East Kline Avenue when police responded to a neighbor’s dispute. On scene police found Augelli yelling at neighbors and appeared intoxicated. She denied she was intoxicated.
The assault occurred on an officer she kicked while being placed in the back of a police cruiser.
She was placed on probation for a year and ordered to get both drug and alcohol and mental health evaluations, and supply a DNA sample. The term runs concurrent with a sentence she is now serving.
Nancy Gruver, 44, of Lehighton, pleaded guilty to two counts of retail theft for incidents on Nov. 13 and Dec. 5, 2020, at the Walmart store in Mahoning Township.
She was placed on probation for 18 months and ordered to supply a DNA sample and make restitution of $58.57.
Kendra L. Chrynwski, 32, of Palmerton, pleaded to one count of possession of drug paraphernalia. She was arrested on Sept. 20, 2020, by state police at Lehighton along East Lizard Creek Road in Bowmanstown, following a vehicle stop. She was a rear-seat passenger in the vehicle. Her plea was done via video from the county prison, where she is currently an inmate.
She was sentenced to serve one to 12 months in prison and ordered to get a drug and alcohol evaluation and zero tolerance imposed on drug or alcohol use.
She was given credit for four days already served.
Christopher Vandine, 41, of Jim Thorpe, pleaded to one count of resisting arrest. He was arrested on Dec. 24, 2019, by Mahoning Township police along Leininger Drive. Police responded to a suspicious vehicle report and found Vandine asleep in a vehicle. While attempting to take him into custody he refused to put his hands behind his back to be handcuffed and officers had to use a stun gun on him. He also refused a blood test.
He was placed on probation for 18 months and ordered to get a drug and alcohol evaluation and render 100 hours of community service.
Kellie Marie Henninger, 45, of Slatington, pleaded to one count of retail theft. She was arrested on Oct. 3, 2020, by Mahoning Township police for an incident at the Walmart store.
She was placed on probation for a year and ordered to get both drug and alcohol and mental health evaluations and supply a DNA sample.
Tami Lynn Simon, 58, of Germansville, Lehigh County, pleaded to one count of retail theft. She was arrested on Oct. 1, 2020, by Mahoning Township police at the Walmart store.
She was placed on probation for six months and ordered to get a drug and alcohol evaluation, supply a DNA sample and make restitution to Walmart for $10.57.
Todd Greene, 47, of Ashfield, pleaded in two pending cases to one count each of resisting arrest and a summary offense of equipment violation on his vehicle. He was arrested on the resisting count on March 18, 2020, by state police at Lehighton along East Lizard Creek Road in East Penn Township. Troopers responded to an unwanted person. On scene troopers learned there was a warrant for Greene’s arrest and attempted to take him into custody and a struggle ensued.
Sentencing was deferred.
Shalanda D. Smith, 29, of Lansford, pleaded to one count of persistent disorderly conduct. She was arrested on Sept. 3, 2019, at the Turkey Hill Market along West Patterson Street. She got into an altercation with a female clerk in the store. The police report indicated extensive damages were done in the store but no restitution was requested.
She was placed on probation for a year and ordered to get a drug and alcohol evaluation and have no contact with the victim.
Alyssa Ashley Bensinger, 32, of Tamaqua, pleaded to one count of persistent disorderly conduct. She was arrested on Sept. 9, 2020, by Lansford police in a wooded area behind Boyer’s Market on West Bertsch Street.
She was placed on probation for a year and ordered to get a drug and alcohol evaluation and zero tolerance imposed on drug or alcohol use.
Jewel L. Cauley, 39, of Lansford, pleaded to one count of harassment, as a summary offense. He was arrested on Dec. 22, 2020, by Lansford police at the midrise with the victim a female resident of the apartment complex.
He was sentenced to time-served, eight to 16 days in prison, and paroled.
Jacob Tyler Hofacker, 28, of Palmerton, pleaded to one count of driving under the influence. He was arrested on Aug. 21, 2017, by Palmerton police along Delaware Avenue for DUI of a controlled substance.
Sentencing was deferred so Hofacker can get a drug and alcohol evaluation.
All defendants sentenced must also pay court costs of about $1,000 and a $50 per month supervision feel while on probation or parole.
