Five placed in special probation program
Five first-time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition program on Thursday by President Judge Roger N. Nanovic II.
If a person successfully completes all conditions of the program their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year on driving under the influence charges, unless otherwise noted.Diana Emma Davis, 55, of Brooklyn, New York, was placed for six months. She was arrested on March 15 along Route 903 in Penn Forest Township by state police at Lehighton.A test showed the presence of a controlled substance.She was assessed $600 for the cost of the program and her license was suspended for 60 days.David Blaine Acree Jr., 35, of Phillipsburg, New Jersey, was arrested on Feb. 1 along Indian Hill Road by Franklin Township police. A test showed 0.07 BAC.He was assessed $450 and his license suspended for 60 days.Amy Lynn Breininger, 22, of Palmerton, was arrested on Jan. 17 along Delaware Avenue by Palmerton police. A test showed 0.10 BAC.She was assessed $450 and her license suspended for 60 days.Maximilian Wolfgang Schmitt, 20, of Tamaqua, was arrested on July 4, 2014, along Route 903 in Penn Forest Township by state police at Lehighton. A test showed the presence of a controlled substance.He was assessed $650 and license suspended for 90 days.Timothy Jay Ulsh, 39, of Lewistown, Mifflin County, was arrested on Nov. 27, 2013, along Maury Road in Penn Forest Township by state police at Lehighton. A test showed the presence of a controlled substance.He was assessed $600 and license suspended for 60 days.All defendants must also pay court costs of about $1,000, pay a $50 per month supervision fee while in the program and must follow all the recommendations of their drug and alcohol evaluation.
