Carbon County court
A Tamaqua man was sentenced to a county prison term last week in Carbon County court on two drug charges while three other defendants in pending criminal cases were placed in the county’s Accelerated Rehabilitation Disposition probation program.
Judge Joseph J. Matika presided.
Lansford incidents
Jason Allen Weaver, 39, was sentenced to serve three to 12 months in prison on two counts of possession of drug paraphernalia. The sentences run concurrently.
Weaver was arrested on Feb. 25, 2020, at Patterson Street and Parkview Road and May 14, 2020, at Patterson and Center streets, both by Lansford police.
He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, pay court costs of about $1,000, pay a $50 per month supervision fee while on parole and render 25 hours of community service.
He was given credit for 70 days already served and will begin the prison term at 1 p.m. on May 24.
ARD placements
The following were placed in the ARD program. If they successfully complete all the conditions of the program their record will be wiped clean, however, if they fail to complete it or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.
Tyler Anthony Borger, 32, of Wilkes-Barre, was placed for six months on a charge of possession of a small amount of marijuana. He was arrested on June 27, 2020, by state police at Pocono following a traffic stop along the turnpike in Kidder Township.
He was assessed $450 for the cost of the program and ordered to render 25 hours of community service.
Michael Green, 53, of Tresckow, Banks Township, was placed for two years on a charge of aggravated assault. He was arrested on Feb. 4 by state police at Hazleton for an incident in the area of West Oak Street in Tresckow involving a trooper and a EMT as the victims. Troopers and the EMT personnel responded to a report of a combative person - Green.
He was assessed $450 and ordered to get both drug and alcohol and mental health evaluations, render 100 hours of community service and attend and successfully complete an anger management course.
Jovani Joseph Rodriguez, 22, of Lehighton, was placed for a year on a charge of driving under the influence of a controlled substance. He was arrested on Aug. 5, 2020, by Weissport police.
He was assessed $600 and ordered to render 50 hours of community service, license suspended for 60 days and follow any recommendation of his drug and alcohol evaluation.
The three must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
