Carbon County court — DUI

Two people were sentenced on Thursday in the Carbon County court on driving under the influence charges.

President Judge Roger N. Nanovic II imposed the sentences. The two previously entered pleas to the charges.

Two counts

Dawn L. Markley, 54, of Lehighton, was sentenced on two DUI counts.

On the first count Nanovic sentenced her to serve 30 days in jail followed by 60 days on electronic monitoring in the Restrictive Conditions of Probation program. The entire length of the placement in the program is five years. She must also pay a fine of $1,500 and her license is suspended for 18 months.

On the second DUI, she must serve 90 days in jail followed by 275 days of electronic monitoring, a fine of $2,500 and another 18 months license suspended. The jail terms run concurrently.

She was also ordered to supply a DNA sample.

She will serve the 90 days on consecutive weekends beginning at 9 a.m. on March 23.

She was arrested for DUI on Aug. 12, 2018, along East Street by Lehighton police. The second arrest occurred on Sept. 20, 2018, also along East Street.

Other case

Nicholas Richard Benner, 31, of Kunkletown, was sentenced on a DUI charge to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension and zero tolerance for drug or alcohol use. On a charge of driving under suspension pay a fine of $500, on a charge driving under suspension - DUI related, pay a fine of $500, and serve 60 to 90 days in jail and on a possession of drug paraphernalia charge serve one year probation. The jail terms and probation run concurrently.

On the first DUI he was given credit for three days served and paroled. On the suspension count he was given credit for 25 days already served.

He will begin serving the remaining time at 6 p.m. on March 28 and serve it on consecutive two-day periods, Sunday to Tuesday.

He was arrested on Jan. 30, 2018, by Lehighton police along Route 443 for the DUI of a controlled substance charge. The possession of drug paraphernalia charge was for an incident on March 24, 2018, also along Route 443 and filed by Lehighton police following a traffic stop.

Both defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.
