A man accused of assaulting a Carbon County law enforcement official will not go to trial, and plans to enter a guilty plea to charges.

Matthew Schutter, 46, of Penn Forest Township, appeared in a Carbon County District Court Friday for a preliminary hearing.Schutter has been charged with felony aggravated assault.The charges stem from an incident on March 28 where he allegedly assaulted Carbon County Chief Detective Tim Nothstein, who was attempting to escort Schutter out of the county courthouse.On Friday, Schutter agreed to waive his right to a preliminary hearing before Senior Judge John Whitesell.Outside the hearing, Schutter and law enforcement officials said that they had reached an agreement whereby Schutter would plead guilty to a misdemeanor charge of assault, and a summary charge of disorderly conduct.In exchange, Schutter will not face the felony charge, which could have carried up to 10 years imprisonment.A person convicted of a second degree misdemeanor could face up to two years imprisonment."I want to move forward," Schutter said.He said that on the day of the alleged incident, he lost his temper, but he said that Nothstein did as well.According to court documents, Nothstein was attempting to remove Schutter because he was banging on the door of the district attorney's office, which he had been locked out of shortly before.Nothstein was holding Schutter's arm when he allegedly twisted his arm "quickly and violently," causing Nothstein to sustain a right thumb injury.Schutter reiterated his desire to run for the 122nd legislative district as a member of the Libertarian Party.Schutter has not filed any petitions or nominating papers for the election.He said that he plans to file them before July 1.
