Eight sentenced in DUI cases

Eight defendants who previously pleaded guilty to driving under the influence charges, were sentenced on Monday by Carbon County President Judge Roger N. Nanovic II.

Sentenced were the following:Michael G. Galade, 38, of Lehighton, was arrested on Dec. 31, 2013, by state police at Lehighton along Bankway in Lehighton. A test showed 0.08 BAC.A first offense, he was placed on probation for six months and ordered to pay a fine of $300.Russell K. Balogach, 24, of Lehighton, was arrested on Sept. 7, 2014, along Constitution Avenue by Lehighton police. A test showed 0.16 BAC.Nanovic placed him on probation for six months and imposed a fine of $300.Glenn G. Galion, 47, of Jim Thorpe, was arrested on July 3, 2014, along Route 209 on the Thomas J. McCall Memorial Bridge in Lehighton. A test showed 0.28 BAC.He was placed on probation for six months and ordered to pay a fine of $300.Jessica Lindsay Hartman, 25, of Lehighton, was arrested on May 10, 2014, by state police at Lehighton along Route 248 in Franklin Township. A test showed the presence of a controlled substance.Nanovic sentenced her to serve 72 hours to six months in jail, pay a fine of $1,000, and suspended her license for one year.She will begin the jail term at 4 p.m. on May 1.Wendy Heiney, 58, of Walnutport, was arrested on June 17, 2014, along Delaware Avenue by Palmerton police. A test showed 0.28 BAC.Nanovic sentenced her to serve five days to six months in jail, a fine of $1,000, have her license suspended for 18 months, and render 100 hours of community service. She was given credit for five days and paroled.Rachael Lauren Keller, 29, of Albrightsville, was arrested on Jan. 6, 2014, along Route 903 in Jim Thorpe by state police at Lehighton. A test showed the presence of a controlled substance.Before the sentencing Keller entered a plea to a theft count filed by Kidder Township police.On the DUI charge Nanovic placed her on probation for six months and ordered her to pay a fine of $300. On a disorderly conduct charge which occurred at the same time, she was placed on probation for a year concurrent to the DUI charge.On the theft charge she was placed on probation for two years consecutive to the other counts, must make restitution of $1,200, and zero tolerance was imposed on drug and alcohol use.Lee B. Kester, 33, of Palmerton, was arrested on May 18, 2013, along Park Lane by Palmerton police. A test showed the presence of a controlled substance.Nanovic sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and complete a methadone maintenance program.On a charge of possession of drug paraphernalia he was placed on probation for a year consecutive to the DUI charge.He begins the jail term at 9 a.m. April 27.Sean Michael Kutz, 37, of Jim Thorpe, was arrested on Aug. 23, 2013, by state police at Lehighton along Fairyland Road in Franklin Township. A test showed the presence of a controlled substance.He was sentenced to serve 72 hours to six months in jail, a fine of $1,000, have his license suspended for 18 months, and render 100 hours of community service.On an endangering the welfare of a child charge he was placed on probation for two years consecutive to the DUI count.His begins the jail term at 8:30 a.m. on May 1.Each defendant was also ordered to follow any recommendations from their drug and alcohol evaluation, pay court costs of about $1,000, and pay a $50 per month supervision fee while on probation or parole.
