Carbon County court
Ten defendants in pending drug-related cases entered guilty pleas in Carbon County court on Tuesday before Judge Roger N. Nanovic II.
Drug trafficking
Albert Zettlemoyer, 30, of Lebanon, pleaded to one count of corrupt organization, a felony 1.
He admitted his part in a drug trafficking operation involved in the distribution of methamphetamine in the Carbon County area. Other illegal substances were also involved.
The case is being prosecuted by the state Attorney General office.
Nanovic deferred sentencing and ordered the adult probation office to prepare a presentence investigation report.
Drug task force
Wash Lee Tyahla, 56, of Nesquehoning, pleaded to one count of possession with intent to deliver a controlled substance, methamphetamine, a felony.
He was arrested on Aug. 1, 2019, as part of an ongoing investigation by the county’s drug task force and Lehighton police into the distribution of illegal drugs in the county. His arrest was the result of a surveillance operation set up by the task force. At the time of his arrest a large quantity of drugs were found on him, according to the police report.
Sentencing was deferred so Tyahla can apply for the house arrest program.
Prison incident
Shyann Nichole Boyer,Patrick Joseph Kelly Jr., 34, of Lansford, entered pleas in two pending cases to two counts of possession of drug paraphernalia.
He was arrested on the first count on Feb. 1, 2019, by Lansford police. When police took him into custody on a warrant he was found with the paraphernalia. The second arrest occurred on Sept. 3, also by Lansford police, following a traffic stop. In both cases counts of possession of a controlled substance were dropped in a plea deal with the district attorney’s office.
Nanovic noted Kelly is currently on five years of probation in Georgia on drug-related charges.
Nanovic sentenced Kelly to serve one to six months in prison on each count, with the terms running concurrently. He was also ordered to get a mental health evaluation and follow any recommendation for treatment.
He will begin serving the prison term at 2 p.m. on Nov. 13.
Anthony Tyrone Bernardo, 46, of Jim Thorpe, pleaded to one count of possession of drug paraphernalia. He was arrested on Feb. 2, 2019, by Lansford police following a traffic stop. He was a passenger in the vehicle. A charge of possession of a controlled substance was dropped in a plea deal.
Sentencing was deferred so the adult probation office can prepare a presentence investigation report.
Daniel Edward Faille, 32, of Lansford, pleaded to one count each of possession of a small amount of marijuana and driving while under suspension. He was arrested by Lansford police on Sept. 5 following a traffic stop.
On the drug count he was fined $250 and on the suspension count he was fined $500.
Wendy Kaminitsky, 42, of Lansford, pleaded to one count of possession of drug paraphernalia. She was arrested on Aug. 16 by Lansford police after officers were dispatched to an area on Patterson Street for a report of a theft. She was found with a pipe used in connection with illegal substances. It was noted she had two prior possession with intent to deliver a controlled substance convictions.
Nanovic placed her on probation for six months and ordered her to get a drug and alcohol evaluation and follow any recommendation for treatment.
Kody Devin Beil, 28, of Palmerton, pleaded to one count of possession of a small amount of marijuana. He was arrested on March 29, 2017, by Palmerton police following a traffic stop. Two counts of possession of a controlled substance were dropped in a plea deal.
Nanovic imposed a fine of $500.
Trevor Austin Evans, 28, of Lansford, pleaded to one count of possession of drug paraphernalia. He was arrested on Sept. 3 by Lansford police along East Bertsch Street. Police responded to the area for a report of an unwanted male. Evans was found and had a warrant for his arrest. While taking him into custody the paraphernalia was found.
It was noted he has a pending driving under the influence case in Schuylkill County. His plea was done via video conference from the county prison where he is being held on a parole violation.
Nanovic sentenced him to serve two to 12 months in prison and ordered he get a drug and alcohol evaluation and imposed zero tolerance for drug or alcohol use.
Kendra Chrynwski, 31, of Wilkes-Barre, entered pleas in two pending cases to one count each of possession of a controlled substance - heroin/fentanyl, driving under suspension, driving a vehicle with a suspended registration and operating a vehicle without a valid inspection sticker.
She was arrested on the drug charge on March 16, 2019, by Lehighton police following a traffic stop. She was arrested on the other three counts, all motor vehicle code summary offenses, on June 4, 2019, by Weissport police following a traffic stop.
On the drug count, Nanovic sentenced her to serve one to 12 months in the county prison with credit for seven days served. On the three summary offenses she was fined a total of $825 and costs.
She will begin serving the remaining 23 days of her prison term on Nov. 23 at 9 a.m. and serve it on consecutive two-day periods of Monday to Wednesday.
Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee if on parole or probation.
