Carbon defendants sentenced on drunken driving charges

Seven defendants who previously pleaded to driving under the influence charges were sentenced on Thursday in Carbon County court.

Judge Joseph J. Matika presided and imposed sentences on the following:James Rodney Stepp, 62, of Walnutport was sentenced to serve 90 days to five years in prison, pay a fine of $1,500, have his license suspended for 18 months and zero tolerance for drug and alcohol use.Stepp will serve the 90 days in the county's Intermediate Punishment Program because of serious health problems. Normally, a defendant would have to serve 30 days in jail and the remainder in the IPP.He was arrested on Sept. 3, 2014, along Lizard Creek Road in East Penn Township by state police at Lehighton. A test showed the presence of a controlled substance.Joseph Anthony Flammia, 25, of Albrightsville, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension and must render 25 hours of community service.He was arrested on Jan. 14 along Blakeslee Boulevard Drive East by Mahoning Township police. A test showed the presence of a controlled substance.He will begin the jail term at 10 a.m. Aug. 24.John Robert Steskal, 46, of Palmerton, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, zero tolerance for D&A use, and render a total of 50 hours of community service.He also pleaded in another case to possession of drug paraphernalia and was placed on probation for a year, concurrent with the DUI count.He was arrested on the DUI charge on Aug. 15, 2014, along Blakeslee Boulevard Drive by Mahoning Township police. A test showed the presence of a controlled substance.He was arrested on the drug count on Aug. 14, 2014, following an incident at the Walmart store in the township. He had a pipe in his possession used to smoke illegal substances.He will begin the jail term at 10 a.m. Aug. 26.James William Riach, 24, of White Haven, was sentenced to serve 48 hours to six months in jail, a fine of $500, one year license suspension and render 25 hours of community service.He was arrested on Aug. 6, 2014, along Route 940 by Kidder Township police. A test showed 0.12 BAC. At the time he was operating an all-terrain vehicle that left the road and landed in a ditch.He will begin the jail term at 6 p.m. Aug. 28.Dezera Colleen Defiore, 23, of Catasauqua, was sentenced to serve 48 hours to six months in jail, a fine of $500, one-year license suspension, zero tolerance on D&A use, and render 25 hours of community service.She was arrested on May 24, 2014, along Route 940 by Kidder Township police. A test result was 0.14 BAC. She was previously placed in the county's Accelerated Rehabilitation Disposition probation program but was revoked for violating conditions.She will begin the jail term at 11 a.m. Aug. 31.Susan Wagher, 48, of Nesquehoning, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, zero tolerance for D&A use, and must render a total of 100 hours of community service.On a second DUI she was placed on probation for a year, consecutive to the first count, pay a fine of $1,500, and license suspended for an additional 18 months.On a recklessly endangering charge stemming from the second DUI, she was placed on probation for a year, concurrent to the others charges.She was arrested on the first DUI on Jan. 15, 2014, along Route 903 by Jim Thorpe police. A test revealed a 0.06 BAC. The second DUI occurred on March 21, 2014, along Route 93 by Nesquehoning police. At the time police found her child in the car. A test revealed the presence of a controlled substance.She will begin her jail term at 10 a.m. on Aug. 28.Nelson John Pollock III, 29, of West Hazleton, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, and render a total of 50 hours of community service. On a possession of drug paraphernalia charge he was placed on probation for six months, consecutive to the DUI count.He was arrested on Nov. 25, 2012, by Weatherly police. A test revealed the presence of a controlled substance.He was previously placed in the ARD program but revoked from it for violating conditions.He will begin the jail term at 10 a.m. Sept. 4.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
