Police find shooting suspect in Va.
A Lansford man who shot his girlfriend several times, narrowly missing her heart, then shot himself in the head in a botched suicide attempt on Feb. 22, 2014, has been found in Virginia after vanishing while recovering at his mother's house.
Levi Zagata, 38, formerly of 439 W. Patterson St., was taken into custody by the Accomack County Sheriff's Department, Lansford police said.They were notified of his capture at 1:45 a.m. May 20. Zagata is charged with criminal attempted homicide, two counts of aggravated assault, and terroristic threats stemming from the incident on Feb. 22, 2014. Police filed the complaint on May 14 with District Judge Casimir Kosciolek of Lansford.It was not known when Zagata would be returned to Pennsylvania.Early argumentAccording to an affidavit of probable cause, Zagata and his girlfriend, Melissa Price, had been arguing during the day.The bickering picked up again after Price's four children, ranging in age from 3 to 12, went to bed.One of the children who was still awake and playing video games in an upstairs bedroom told police he heard Zagata and Price come upstairs. It was about 10:30 p.m.The boy heard three gunshots, and his mother calling for help.The child ran to a neighbor's house for help, and told police he thought he heard another gunshot as he arrived there.The neighbor told police she had heard three "distinct sounds" in a row, describing them as "wood slapping the ground."Then, she heard a fourth. The sounds came from the Zagata/Price household.Lansford Det. Jack Soberick was dispatched to the house for a domestic dispute by the Carbon County Communications Center. Just before he arrived, a dispatcher told him a second caller had said shots were fired and that two people had been shot.That caller, it turns out, was Zagata.Soberick approached the front door, flanked by officers Jeff Ohl and Todd Woodward. Zagata stood there, a pillow clutched to his face, bleeding profusely from a single gunshot wound.As police searched the house, a female voice could be heard, calling softly for help from upstairs.'Don't let me die'They found Price lying on the bedroom floor. She told police she could not move or breathe. She had been shot multiple times in the torso, including near the center of her chest."Price asked me not to let her die there on the floor," Soberick wrote in the affidavit.There was a large amount of blood pooled on the bed, and a Kel-tec brand 9 mm pistol was on the floor near the foot of the bed.A spent casing was on the floor near Price's feet.Price told police she and Zagata had argued. When she went into their bedroom, Zagata was there."How about this?" she quoted him as saying.As she turned toward him, Zagata pulled the pistol from under the mattress and shot her three times. The bullets entered her left chest, her left abdomen, and her upper chest/breastbone.She fell backward onto the floor and began calling for help.Zagata told her to shut up.The last thing she remembered was Zagata calling 911 and walking out of the bedroom, a pillow to his face.Soberick, in a review of the 911 call, learned that Zagata had called and reported shots fired after a struggle with a gun. Zagata also reported that he was shot.When the dispatcher asked who shot him, Zagata replied "I did."Multiple surgeriesPrice, whose injuries were described as "serious and life-threatening," had multiple emergency surgeries after being flown to a hospital.Earlier news reports say the two were taken by Lehighton Ambulance to St. Luke's Miners Memorial Medical Center in Coaldale, then flown to trauma units.Price was flown to Lehigh Valley Hospital, Cedar Crest, while Zagata was transferred to the University of Pennsylvania Hospital in Philadelphia.According to earlier news reports, Zagata's brother, David J. Zagata II, is the children's father.On Nov. 11, 2012, David Zagata entered Levi and Melissa's house and "became violent and threatening," according to court papers.At that time, according to an affidavit, David Zagata threatened to kill Levi and the children.Also at that time, he armed himself "with a large knife from a drawer in the kitchen," and forced Levi to leave with him. Levi was later found in St. Clair.
