A Lehighton man appeared for his sentencing on a driving under the influence charge on Monday in Carbon County court. Instead of being sentenced, he spent the night in the county prison.
Brian Keith Jerden, 40, appeared in courtroom three at the courthouse before Judge Steven R. Serfass. Before the start of the proceeding, court personnel detected the odor of an alcoholic beverage on Jerden. He then submitted to a breath test administered by a member of the adult probation office.When is case was called Serfass asked Jerden if he had anything to drink that morning. Jerden said no, but that he had a "few Budweisers" the night before, having his last one about 10 p.m.The breath test revealed a 0.089 BAC. Serfass said he didn't believe that Jerden's last drink was at 10 p.m. He also told Jerden to come to court intoxicated was disrespectful to the court.Serfass then found Jerden in contempt of court and ordered him held in the county prison overnight.On Tuesday morning Jerden appeared for sentencing.Serfass then placed him on probation for six months as a first-time offender, and ordered he pay a fine of $300 and a $50 per month supervision fee while on probation.Jerden was arrested on Mach 20, 2013, along Route 248 in Palmerton by state police at Lehighton. He was originally stopped for speeding, going 70 mph in a 55 zone.He was found to be under the influence and submitted to a test. The test result was 0.17 BAC.
