Driver in fatal crash sentenced on DUI charge

One of two defendants involved in a fatal crash was sentenced in Carbon County court on Monday on a driving under the influence charge.

He was one of eight defendants in drunken driving cases who previously pleaded guilty to be sentenced by Judge Steven R. Serfass.Paul Gerard Herman, 54, of Jim Thorpe, was sentenced to serve 72 hours to six months in prison on one count of DUI.Herman was charged following a crash that occurred on Aug. 18, 2013, along Route 903 in Penn Forest Township. Herman was the operator of a motorcycle that was involved in a crash with another vehicle. Herman's passenger, Debra L. VanPattern, who resided with him, died at the scene of the crash.The other driver involved, Steven P. McKenzie, of Scotrun, has also pleaded guilty to DUI and four summary motor vehicle code violations. His sentencing is pending.Neither driver was charged by state police at Lehighton with offenses concerning the death of VanPattern.Herman and McKenzie both dispute how the crash occurred. McKenzie was following Herman northbound when he said Herman pulled his cycle onto the berm. As he attempted to pass Herman, McKenzie said Herman pulled back onto the road and struck his vehicle. Herman claims that McKenzie's vehicle struck his cycle in the rear, forcing it to crash along the berm.In addition to the jail term, Herman was ordered to pay a fine of $1,000, have his license suspended for a year, and must render 25 hours of community service.He will begin the jail term at 9 a.m. April 24.
