Man faces drug paraphernalia charges
A Palmerton man who intended to deliver drug paraphernalia will have charges bound over to Carbon County Court.
Barry Tindula, 33, was scheduled to have a preliminary hearing Wednesday before District Judge William Kissner of Palmerton.Instead, Tindula waived his right to a hearing, and will appear June 16 for a pretrial status conference in the district attorney's office at the Carbon County Courthouse in Jim Thorpe.Tindula faces charges of possession of drug paraphernalia, possession with intent to manufacture/deliver, theft by unlawful taking or disposition, and unlawful possession of a controlled substance.He remains incarcerated in Carbon County Correctional Facility in lieu of $15,000 bail.According to the affidavit filed by Aaron Laurito of the Pennsylvania Office of Attorney General, Bureau of Narcotics Investigation and Drug Control:On April 21, Laurito was privy to a controlled buy of methamphetamine from Tindula.A confidential informant contacted Tindula on a cellphone and through Facebook, and ordered $100 worth of methamphetamine.Tindula told the informant to meet him at his residence at 140 Delaware Ave.At 12:45 p.m., Laurito and Agent Jodi Canady met with the informant at an undisclosed location.The informant was given specific instructions in the role as an informant, and was given $100 in serialized currency for the purchase.The informant and Canady traveled to 140 Delaware Ave.At 1:11 p.m., Tindula exited the apartment building and entered the informant's vehicle, at which time the informant handed Tindula the prerecorded money with the understanding Tindula would return with methamphetamine.About 30 minutes later, Tindula did not return to the informant.The agents and Palmerton Police went to Tindula's apartment, but he was not present.A short time later, Tindula was observed inside the apartment and was arrested without incident. A cursory pat-down seized five packets of heroin, a syringe, and $40 of the prerecorded currency.Tindula was advised of his Miranda warnings and waived them in writing. Tindula admitted his role in the admitted delivery of methamphetamine and possession of heroin, along with a syringe.
