Carbon County court - parole/probation revocation
Parole/probation revocation hearings of petitions filed by the adult probation office against defendants who violated the terms of their release were held by county judges recently.
The results of those hearings follow:Justine Simon, 41, of Nesquehoning, had her probation revoked on a charge of possession of drug paraphernalia on petition of probation officer Clifford Eckhart for violating conditions by admitting use of controlled substances, violating zero-tolerance condition and failing to engage in drug and alcohol treatment.Judge Joseph J. Matika resentenced her to serve 90 days to 12 months in the county prison with credit for 40 days already served.Jordan Grammes, 23, of Albrightsville, had his parole revoked on a driving under the influence charge on petition of probation officer Joseph Bettine for violating conditions by failing to report to the probation office as directed on two occasions.Judge Steven R. Serfass resentenced him to serve the balance of his maximum term, which is March 6, 2021. He will be released from the prison on April 1 to enter an inpatient rehabilitation program with the condition he must successfully complete the program. If not, an arrest warrant will be issued for him.James Simmons, 25, of Weatherly, had his parole revoked on a charge of possession of a controlled substance on petition of Bettine for violating conditions by being arrested by Slatington police on Feb. 6 on new drug charges.Serfass resentenced him to serve the balance of his sentence which runs to May 9.Eric Safianow, 22, of Jim Thorpe, had his parole revoked on a charge of possession with intent to deliver a controlled substance, and in a second case on a charge of possession of drug paraphernalia on petition of Bettine for violating conditions by testing positive for cocaine and opiates, failing to report for scheduled urine screen and violating the zero-tolerance condition.Matika resentenced him to serve 90 days "street time," which is effective Feb. 4.Steven Holtzer, 24, of Lansford, had his probation revoked on a charge of theft by unlawful taking on petition of Eckhart for violating conditions by failing to report to the probation office as directed and not engaging in drug and alcohol treatment.Matika resentenced him to serve 40 days to 12 months in prison with credit for 35 days already served.Wade Matika, 25, of Lansford, had his parole revoked on a charge of DUI on petition of Eckhart for violating conditions by failing to perform 25 hours of community service.Serfass resentenced him to serve 25 days in the county prison which began on March 16 with credit for 15 already served.Kristy Binder-Muffley, 34, of Weatherly, had her probation revoked on a charge of persistent disorderly conduct on petition of Bettine for violating conditions by failing to make a concerted effort to pay court costs and failing to complete 50 hours of community service.Serfass resentenced her to serve three to six months in the county prison effective Aug. 15. If she completes the community service and pays $1,000 on her court costs by that date, the order will be vacated.ARD revokedWhitney McVicker, 22, of Albrightsville, was revoked from the Accelerated Rehabilitation Disposition probation program on a charge of possession with intent to deliver on petition of Bettine for violating conditions by testing positive for methamphetamine which violated the zero-tolerance condition.Serfass ordered the case placed on the next available pretrial list.Bail violationsMaria Alfeo, 27, of Lansford, had her bail revoked for violating the conditions of the pretrial services program. Her bail was set at $25,000 unsecured. She violated the conditions by testing positive for a controlled substance which violated the zero-tolerance condition.Bail was reset at $25,000 percentage (10) and she was remanded to the county prison unable to post the bail.Nicole Oplinger, 36, of Lansford, had her bail revoked for violating the terms of the pretrial service program. Her bail was set at $150,000 unsecured. She violated conditions by failing to report to the probation office as directed, failing to submit to a scheduled drug screen which violated the zero-tolerance condition.Her bail was reset at $150,000 percentage (10), and she was remanded to the county prison unable to post the bail.
