Schuylkill OKs plea deal in West Penn death case

The man who ran over and killed a West Penn Township business owner in August 2023 pleaded guilty to involuntary manslaughter and theft of services.

Through the plea deal, Michael Albert, 63, of White Haven, was sentenced to 11½ to 23 months with credit for time served in Schuylkill County Prison.

Albert had originally been charged with third degree murder in the death of Mark Boyle. He was also facing homicide by vehicle, aggravated assault, reckless endangerment and reckless driving charges before the plea deal was reached on June 16 in the Schuylkill County Court of Common Pleas.

The charges stemmed from an Aug. 2, 2023, incident in which Albert, then of Scranton, drove a dump trunk over Boyle at Mark T. Boyle Welding and Industrial Sandblasting on Penn Drive.

West Penn Police said Albert was a customer who arrived to pick up his truck but was told he couldn’t have it until he paid for the work done.

Albert then got into the driver’s seat and began to drive it away. Police said Boyle attempted to stop Albert, but Albert swerved and ran him over.

Boyle passed away hours later.

According to court paperwork, Albert was sentenced to 11 ½ to 23 months on the involuntary manslaughter charge. On a theft of services charge, he was sentenced to 12 months probation to be served concurrently with the jail time.

Albert had served 371 days in jail at the time of the plea deal.
