Weatherly man shot gun, injured himself

A Weatherly man has been charged after he shot off a gun in his home and injured himself.

According to the affidavit of probable cause filed by officer Edward Kubert of the Weatherly Police Department in the case against Gilbert Garcia, 49:

At 4:47 p.m. Feb. 12, Kubert was notified by Carbon County Communication Center that Hazleton Lehigh Valley Hospital had a gunshot victim admitted in the emergency room from an incident in the 300 block of First Street in Weatherly.

Kubert responded to the hospital, where Garcia, was in the emergency room with a gunshot to his left hand.

Garcia said that he was cleaning his Derringer on the kitchen table when it went off.

A woman who lives at the same address was in the emergency room with Garcia and told Kubert that she was sitting at the kitchen table when the gun went off, and that she felt the wind of the gun going past her when the gun fired.

Garcia and the woman gave permission to enter the house and seize the firearm.

Garcia was discharged from the hospital after receiving treatment for his left hand, at which time Kubert followed him to his home.

Garcia walked Kubert and borough police Chief Brian Markovchick into the residence and showed them where he put the gun.

Kubert seized the FMJ Derringer with one spent shell and one loaded shell.

Garcia then showed Kubert and Markovchick the location where he shot his left hand.

Garcia came to the Weatherly Police station where he provided a statement about how he purchased the handgun at a yard sale.

Garcia’s criminal history shows that he is a felon not to possess a firearm.

Garcia faces charges of possession of firearm prohibited, discharge of a firearm into occupied structure, and recklessly endangering another person.

Garcia is currently free in lieu of $25,000 unsecured bail, and scheduled to have a preliminary hearing March 27 before District Judge Joseph D. Homanko Sr. of Weatherly.
