Carbon County Court - DUI sentencings

Carbon County Judge Steven R. Serfass recently sentenced eight people who admitted to driving while under the influence.

Aidan Michael Frank, 21, of Albrightsville, was charged by Lehighton State Trooper Anthony K. Kingsley with manufacture, delivery, or intent to manufacture or deliver a controlled substance; possession of a small amount of marijuana; possession of drug paraphernalia; possession of a controlled substance; DUI: minor, first offense; DUI: incapable of driving safely, first offense; DUI: controlled substance, combination of alcohol and drugs, first offense; DUI: controlled substance, schedule 1 drug, first offense; DUI: controlled substance, impaired ability, first offense; purchase of alcoholic beverage by a minor; disregarding traffic lanes; and careless driving on March 12, 2023.

On the charge of DUI: controlled substance, Judge Serfass fined Frank $1,000, and sentenced him to serve 72 hours to six months in Carbon County Correctional Facility.

He’s to report to jail on Dec. 12.

Judge Serfass also ordered him to pay court costs; $50 monthly supervision fee; undergo a drug and alcohol evaluation; perform 25 hours of community service; and surrender his license for. 12 months.

On the charge of possession of a controlled substance, Judge Serfass ordered Frank to pay court costs; a $50 monthly supervision fee; serve six months on probation after his jail sentence; and perform 25 hours of community service.

The remaining charges were dropped.

Cody Lee Parsons, 29, of Palmerton, was charged by Lehighton State Trooper Anthony K. Kingsley with DUI: highest rate of alcohol, first offense; DUI: incapable of driving safely, first offense; careless driving; and disregarding traffic lanes on Jan. 30, 2021.

On the DUI: incapable of driving safely charge, Judge Serfass fined him $300; ordered him to pay court costs; a $50 monthly supervision fee; serve six months on probation; undergo a drug and alcohol evaluation; and render 25 hours of community service.

The remaining charges were dropped.

In a separate case, Parsons was charged by Lehighton State Trooper John A. Heffner with DUI: highest rate of alcohol, second offense; DUI: incapable of driving safely, second offense; careless driving; and disregarding traffic lanes on July 2, 2022.

Judge Serfass fined Parsons $500 on the general impairment charge; and ordered him to pay a $50 monthly supervision fee and court costs; serve five days to six months in Carbon County Correctional Facility, beginning Dec. 29; surrender his license for 12 months; undergo a drug and alcohol evaluation and render 25 hours of community service.

The remaining charges were dropped.

Gary Richard Bishop, 51, of Lehighton, was charged by Lehighton State Trooper Matthew A. Treible with DUI: highest rate of alcohol, first offense; evading arrest; careless driving; not using headlights; not using turn signals; two counts of disregarding traffic lanes; failing to keep right; and DUI: incapable of driving safely, first offense, on June 5, 2023.

Judge Serfass on the DUI: incapable of driving safely charge fined him $300; ordered him to pay court costs and a $50 monthly supervision fee; serve six months on probation; and render 25 hours of community service.

The remaining charges were dropped.

Charles Brian Jackson, 56, of Coopersburg, Lehigh County, was charged by Lehighton State Trooper John A. Heffner with DUI: controlled substance, schedule 2 or 3 drug, first offense; DUI: controlled substance, impaired ability, first offense; disregarding traffic lanes; no rear lights; careless driving; and violating hazard regulations on Feb. 12, 2023.

Judge Serfass on the DUI: controlled substance charge fined Jackson $1,000; ordered him to pay court costs and a $50 monthly supervision fee; serve 72 hours to six months on jail, starting on Dec. 15; undergo a drug and alcohol evaluation; surrender his license for 12 months; and serve 25 hours of community service.

The remaining charges were dropped.

Wendy Colleen Kneller, 50, of Lehighton, was charged by Mahoning Township Police Chief Audie M. Mertz with DUI: controlled substance, impaired ability, first offense, of Jan. 21, 2019.

Judge Serfass fined her $1,000; ordered her to pay a $100 LiveScan fee; a $50 monthly supervision fee; serve 72 hours to six months in jail, with six days’ credit; surrender her license for 12 months; obtain a drug and alcohol evaluation; and render 25 hours of community service.

Shane Derrick Matthews, 38, of Lehighton, was charged by Lehighton State Trooper Gary N. Fedor with

DUI: controlled substance, schedule 2 or 3 drug, first offense; DUI: controlled substance, impaired ability; driving an unregistered vehicle; not having a proper muffler; and careless driving on Jan. 17, 2023.

On the count of DUI: impaired ability, Judge Serfass fined Matthews $1,000; ordered him to pay a $50 monthly supervision fee; serve 72 hours to six months in jail, with 24 days’ credit; surrender his license for 12 months; obtain a drug and alcohol evaluation; and render 25 hours of community service.

The remaining charges were dropped.

Penny Jo Zimmerman, 53, of Lehighton, was charged by Lehighton State Trooper Anthony K. Kingsley with DUI: highest rate of alcohol, third offense; DUI: incapable of driving safely, third offense; careless driving; trespass by vehicle; on Aug. 12, 2022.

On count 2, Judge Serfass sentenced Zimmerman to pay court costs; fined her $500; ordered her to pay a $50 monthly supervision fee; placed her on probation for 24 months; to serve 30 days on electronic monitoring/inpatient program, to start within 30 days of her release from jail; surrender her license for 12 months; render 100 hours of community service; complete the Alcohol Highway Safety program; and undergo a drug and alcohol evaluation.

The remaining charges were dropped.

Michelle Alyse Crawn, 57, of Kunkletown, was charged by Lehighton State Trooper Mark E. Bower with

DUI: controlled substance, schedule 2 or 3 drug, second offense; DUI: controlled substance, impaired ability to drive, second offense; driving an unregistered vehicle; disregarding traffic lanes; careless driving; and reckless driving on May 26, 2022.

On the first count, Judge Serfass sentenced Crawn to pay court costs; fined her $1,500; ordered her to pay a $50 monthly supervision fee; placed her on probation for 60 months; to serve 30 days in jail, beginning Jan. 8, with immediate work release and 14 days credit; participate in electronic monitoring/inpatient program for 60 days, to start within 30 days of her release from jail; submit a DNA sample and pay the $250 fee; obtain a drug and alcohol evaluation; surrender her license for 18 months; and complete the Alcohol Highway Safety program.

The remaining charges were dropped.
