Municipal liens filed

Jim Thorpe Borough, 101 E. 10th St., has filed a municipal lien against Elaine Cuoco, 304 North Ave., Jim Thorpe. The borough is seeking $1,919.72 for unpaid garbage bill from May 1, 2018, to June 30, 2022.

The borough also filed a municipal lien against Clyde Rendell Shoop, 330 Center St., Jim Thorpe. The borough is seeking $454.27 for a unpaid garbage bill from July 1, 2021, to June 20, 2022.

A lien has also been filed by the borough against Dimas Lopez, 109 North Ave., Jim Thorpe. The borough is seeking $1,300.75 for an unpaid garbage bill from April 1, 2019, to June 30, 2022.

Beaver Meadows Borough, 100 Broad St., Beaver Meadows, has filed a municipal lien against Rosemary Grimm, Joseph Onderko and Mary Onderko, 128 Penrose St., Beaver Meadows. The borough is seeking $1,100 for unpaid fees for grass cutting at the above-listed property.

Landlord takes action

Pier 6 Ventures, LLC, Allentown, has filed a civil complaint against Lynette Lesher, 80 Hillside Ave., No. 2, Palmerton, seeking judgment in the amount of $2,193.54 for the period of Oct. 14, 2022, to Dec, 31, 2022, plus an additional $850 per month thereafter, plus costs and expenses.

The complaint alleges an action in ejectment and unjust enrichment, contending the defendant occupies the residence without a lease agreement.

Township files suit

Kidder Township, with offices at Lake Harmony, has filed a civil action against William H. Vanderslice, Northampton, and Robert Faryna, 1209 Blue Mountain Road, Danielsville.

The suit states the defendants are owners of a property located along Laurel Lane in the township in which an assortment of material has accumulated there, including campers, a bus and assorted refrigerators, sheds, etc.

The township contends the defendants are operating a junk yard in a residential zoned area and asks the court to abate the nuisance created on the premises.

Negligence is alleged

Damages in excess of $50,000, plus costs, are being sought in a civil complaint alleging premises liability issues against Tonya Ann Muncey, Birdsboro, over a property at 173 S. Lake Drive, Lake Harmony.

The plaintiff is Katherine Vousden, Woodside, New York, who alleges she was injured in a fall at the residence due to the defective and dangerous condition of a staircase on the property. The incident happened on March 8, 2022.

Vousden contends she sustained severe injuries resulted from the defendant’s negligence in not conforming with local building codes for the defective steps.

Objects to tax sale

Kush and Min, LLC, Stroudsburg, has filed an objection to an upset tax sale conducted by the county on Sept. 26, 2022, claiming the county did not comply with the Pennsylvania Real Estate Tax Sale Law before selling its property.

The county’s tax claim bureau and David Keller, Macungie, the purchaser of the property, are named defendants.

The property, located at 469 State Rt. 940, North Kidder Township, was sold to Keller for $36,410.

Seeks assessment funds

The Holiday Poconos Civic Association has filed a complaint against John Ventre, Norristown, that involves a property the defendant owns along Breezewood Drive in the development.

The suit claims the defendant has failed to pay $2,324 in assessments, fees, charges and expenses owed the plaintiff.

Credit default actions

Truist Bank, Lumberton, North Carolina, has filed a credit card default action against Stephen Thompson, 210 Plane St., Weatherly. Sought is judgment in the amount of $16,353.91, plus costs.

Citibank, N.A., Sioux Falls, South Dakota, has filed a credit card default action against Vickie Kellner, 1868 Blakeslee Boulevard Drive East, Lehighton. Sought is judgment in the amount of $6,968.34, plus costs.

Transcripts of judgments in their favor have been placed on record by the following:

LVNV Funding, LLC, Canonsburg, filed a judgment against Paul Kelley Jr., 712 Columbia Ave., Palmerton. The judgment in the amount of $4,917.92 was ordered by Magisterial District Judge William J. Kissner, Palmerton, on Feb. 10.

Synchrony Bank, Canonsburg, filed a judgment against Candy Desrosiers, 20 Race St., Weatherly. The judgment in the amount of $5,701.06 was ordered by Magisterial District Judge Joseph D. Homanko Sr., Weatherly, on May 7, 2021.

The bank also filed a judgment against Wilbert Johnson, 205 Brittany Drive, Albrightsville. The judgment in the amount of $3,330.46 was ordered by Magisterial District Judge Eric M. Schrantz, Jim Thorpe, on Sept. 7, 2021.

Prothonotary report

Prothonotary Kayla M. Semmel released the statistical report of activities for her office for the months of October and November 2022.

October report

For October there were 346 cases started in August with the following breakdown: Civil actions, 30; custody, 12; DJ appeal, 6; divorce, 15; ejectment, 1; license appeal, 2; mortgage foreclosures, 9; mandamus, 1; protection from abuse, 29; quiet title, 2; CT appointment, 1; judgments, 184; Stip/waiv liens, 5; custody modifications, 11; miscellaneous, 4; tax sale, 5; PFSVI, 3; writs, 26.

A total of 38 passport applications were processed in October. In addition, a total of 19 renewal applicants sought assistance from the office; and 40 photos were taken. Passports are by appointment and pictures can now be taken in the office.

Total income generated was $35,182.55; prothonotary fees, $28,420.03; custody/divorce fees, $2,137.50; data processing fees, $4,311.94; interest income, $207.08; PFA surcharge sheriff, $25; and stenographer fess, $81.

In addition to the above fees, the office remitted to the county for the remote access fund for remote access fees of $1,500, remitted to the state department of revenue (fees collected on new cases) $4,070.29; and automation fund $1,135, which money collected for future automation and improvements to the office.

Sales tax money turned over to the state for tax on passport photos, $34.

November report

For November there were 420 cases started with the following breakdown: Civil actions, 26; assessment appeal, 6; custody, 14; DJ appeal, 5; divorce, 13; ejectment, 2; license appeal, 3; mortgage foreclosures, 13; protection from abuse, 22; quiet title, 5; declaratory judgment, 1; judgments, 285; Stip/waiv liens, 1; custody modifications, 10; miscellaneous, 2; tax sale, 3; protection of victims of sexual violence or intimidation, 1; mental health, 1; and writs, 8.

A total of 41 passport applications were processed in November. In addition, a total of 20 renewal applicants sought assistance from the office; and 42 photos were taken. Passports are by appointment and pictures can now be taken in the office.

Total income generated was $36,879.24; prothonotary fees, $28,637.65; custody/divorce fees, $2,100; data processing fees, $45,558.40; interest income, $94.19; PFA surcharge sheriff, $225; PFA surcharge courts, $225; and stenographer fess, $39.

In addition to the above fees, the office remitted to the county for the remote access fund for remote access fees of $1,500, remitted to the state department of revenue (fees collected on new cases) $5,585.29; and automation fund $1,555, which money collected for future automation and improvements to the office.

Sales tax money turned over to the state for tax on passport photos, $23.80.
