Year in Review: Lower Towamensing overcomes rough start

The year started off a little uncertain for Lower Towamensing Township supervisors.

Terry Kuehner had been elected to serve on the board of supervisors in November 2021, but he couldn’t serve because of his prior felony convictions.

A reorganization meeting was scheduled for Jan. 3, but when the day came around, there was not a quorum so the meeting was canceled.

The next day, Carbon County District Attorney Michael Greek filed a Quo Warranto complaint alleging that Kuehner cannot hold an elective office because of prior felony criminal convictions in accordance with the state constitution. The injunction petition asked the court to not allow Kuehner to participate in supervisors meetings, specifically from voting on any township business, until the court could hold a hearing and decide on the ruling.

That injunction hearing was held on Jan. 10, but Kuehner asked Judge Joseph J. Matika to give him time to hire an attorney. Matika granted the request and the hearing was continued to Jan. 21.

On Jan. 21, Kuehner told the judge that he had spoken to an attorney in Harrisburg and he would voluntarily resign.

Kuehner then submitted a letter of resignation to the district attorney and township’s board of supervisors.

In April, Michael Takerer was approved by Supervisors Brent Green and Connie Brown to fill the vacant seat.
