Carbon County Court - Sentencings

Three defendants in pending criminal cases were sentenced recently in Carbon County court.

The three previously entered guilty peas before Judge Joseph J. Matika.

Two DUIs

Jovani Joseph Rodriquez, 23, of Lehighton, was sentenced on two driving under the influence charges.

On the first count he was placed in the county’s Restrictive Conditions of probation program (house arrest) for six months. He was sentenced to two days in jail, with credit for two already served, and then 13 days on electronic monitoring. He was also ordered to pay a fine of $1,000, license suspended for a year and render 25 hours of community service.

He was originally placed in the county’s Accelerated Rehabilitation Disposition probation program but was revoked from it for violating conditions.

On the second charge he was placed in the house arrest program for 60 months but must spend 30 days in jail first, with credit for two already served. Upon his release from jail he will spent 60 days on electronic monitoring, pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service. The jail term run concurrent with the first count. He began the jail term immediately.

He was arrested on the first count on Aug. 5, 2020, by Weissport police and on the second count on May 2, 2021, by state police at Lehighton. In both cases the DUI was for controlled substances.

Matthew Elliot Markley, 33, of Lehighton, was sentenced to time-served (93 days) to two years in jail on a DUI count. He was ordered to pay a fine of $500, license suspended for 18 months, submit a DNA sample and render 100 hours of community service.

He was arrested on Jan. 11, 2020, by Lehighton police.

Paul David Weirich, 35, of Coaldale, was sentenced to serve two to six months in jail on a charge of receiving stolen property. In exchange for the plea felony counts of burglary and criminal trespass were dropped. He was arrested on Feb. 6, 2020, by Franklin Township police.

He was also ordered to make restitution of $63,84, no contact with the victim, and stay off the victim’s property.

The jail term began immediately. The sentence runs concurrent with a Schuylkill County case.

Each defendant must also pay court costs of over $1,000 and a $50 per month supervision fee while on probation or parole.
