Carbon joins suit against state over mail-in ballots

Carbon County is entering into an agreement for legal services as part of litigation filed by the Republican National Committee against the state over mail-in ballots.

On Thursday, the commissioners ratified an engagement letter with Babst, Calland, Clements and Zomnir PC of State College to represent the county in the action that was filed in Commonwealth Court.

Carbon is one of 14 counties that will be represented by the firm in the matter. The cost of the legal services will be shared by the 14 counties.

County Solicitor Robert Frycklund said that the 14 counties are asking to be released from the litigation because it involves the way counties handled mail-in ballots that were received with missing information.

Some counties had a process to contact the voter to have them come in and rectify the matter. Carbon did not have that policy in place.

Because of this, the Republican National Committee filed the suit against the state on Sept. 1.

The suit claims “several county boards of elections, acting on their own initiative, are departing from those rules in a crucial area of election administration. The result is a lack of transparency, unequal treatment of otherwise identical ballots based upon the county in which the voter resides and an erosion of public trust.”

Frycklund said that the Democratic National Convention has also petitioned to intervene in the lawsuit.

“It’s probably going to be between those two committees,” he said.
