A Luzerne County man was sentenced to a county prison term on Tuesday afternoon on a drug-dealing charge.

He was one of six defendants who previously entered guilty pleas to criminal charges and were sentenced by Judge Steven R. Serfass.

Christopher Peter Fischi Jr., 53, of Hanover Township, was sentenced to serve nine to one day less 24 months in prison on a charge of criminal use of a communication facility, a felony 3. In exchange for the plea two counts of possession with intent to deliver a controlled substance, felonies, were dropped in a plea deal with the DA’s office.

He was arrested on Nov. 24, 2014, by agents of the Attorney General’s office along Willow Lane in Nesquehoning, where he sold drugs to a confidential informant.

Fischi is currently an inmate in the county prison.

He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed on drug or alcohol use, supply a DNA sample and render 100 hours of community service when paroled.

He was given credit for 55 days already served on the charge.

Charlie W. Wiley, 38, of the county prison, was sentenced to serve three to one day less 24 months in the county prison on a charge of receiving stolen property.

He was charged by Jim Thorpe police for an incident on Aug. 5, 2020, at the Turkey Hill along Susquehanna Street where he stole a cellphone of a borough resident.

He was also ordered to get a drug and alcohol evaluation and render 100 hours of community service when paroled. He was granted work-release privileges if he secures employment.

On Monday he appeared before Judge Joseph J. Matika and pleaded to one count of defiant trespass for an incident at Split Rock Lodge in Kidder Township. He was sentenced to time-served in that case.

Patrick Herbert Jr., 43, of Wilkes-Barre, was sentenced to serve one to one day less 24 months in the county prison on a charge of simple assault.

He was charged by Jim Thorpe police for an incident on Aug. 29, 2018, at a residence along High Street. Police responded to the scene and learned from the female homeowner that Herbert had wanted to stay at the home overnight and was told he couldn’t. An altercation occurred and the female said she had been assaulted.

He was also ordered to make restitution to the victim for $149, get both drug and alcohol and mental health evaluations, attend and successfully complete an anger management course and have no contact with the victim.

He will begin serving the prison term at 9 a.m. on March 22, and was given credit for 11 days already served.
