Carbon County court — DUI cases

A total of 10 defendants in pending driving under the influence cases entered guilty pleas recently in Carbon County court.

President Judge Roger N. Nanovic II accepted pleas from the following:

Nelson R. Stanley, 36, of Lehighton, was arrested on March 31 by state police at Lehighton for DUI of a controlled substance. He also pleaded to driving under suspension - DUI related.

Sentencing was deferred so he can obtain a drug and alcohol evaluation and apply for placement in the house arrest program.

Brady David Niehoff, 24, of Lehighton, was arrested on May 8 by state police at Lehighton for DUI of alcohol.

A first offense for sentencing purposes, he was placed on probation for six months and ordered to pay a fine of $300.

David Allen Dotterer, 35, of Bath, was arrested on Jan. 16, 2020, by state police at Lehighton for DUI of a controlled substance.

He was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and license suspended for a year.

He will begin serving the jail term at 5 p.m. on Nov. 12.

Patrick Matthew Partington, 34, of Lehighton, was arrested on July 24 by Lehighton for DUI of alcohol.

He was placed on probation for six months and ordered to pay a fine of $300.

Jacob J. Stallone, 63, of Weatherly, was arrested on March 4 by state police at Hazleton for DUI of alcohol.

He was placed on probation for six months and ordered to pay a fine of $300.

Ryan D. Johnson, 37, of Coplay, was arrested on Aug. 13, 2020, by Palmerton police for DUI of alcohol.

He was placed on probation for six months and ordered to pay a fine of $300.

Benjamin Lee Delong, 27, of Palmerton, was arrested on Feb. 2 by Palmerton police for DUI of alcohol.

He was placed on probation for six months and ordered to pay a fine of $300.

Ronald Miller, 70, of Weatherly, was arrested on Feb. 27 by Weatherly police for DUI of alcohol. He also pleaded to driving under suspension - DUI related.

Sentencing was deferred so he can apply for the house arrest program.

Antonio Cespedes, 20, of Allentown, was arrested on Jan. 2 by state police at Lehighton for DUI of a controlled substance.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

James E. Serfass, 63, of Lehighton, was arrested on Dec. 20, 2020, by Palmerton police for DUI of a controlled substance. He also pleaded to driving under suspension - DUI related. His plea was done via video from the state correctional institution at Houtzdale, Clearfield County, where he is serving another sentence.

Nanovic noted the conviction is his fourth for DUI.

Sentencing was deferred.

Sentencings

The following two defendants previously pleaded guilty to DUI counts and were sentenced.

Felix Antonio Baez, 26, of Lansford, was sentenced to serve 10 days on electronic monitoring and a total of six months in the Restrictive Conditions of Probation program (house arrest). He must also pay a fine of $1,000 and his license was suspended for a year.

He was arrested on May 19, 2018, by Lansford police.

Russell M. Jacoby, 54, of Slatedale, was sentenced to serve 90 days to five years in prison, pay a fine of $1,500 and license suspended for 18 months. He must also supply a DNA sample.

He was arrested on Nov. 22, 2020, by state police at Lehighton.

He began the jail term at 9 a.m. on Oct. 24.

Each defendant must also pay court costs of over $1,000, a $50 per month supervision fee while on probation or parole and follow all recommendations of their drug and alcohol evaluation.
