Man charged with harassment after baseball bat incident

Wuilmary Martinez, 34, of Hazle Street, Tamaqua, has been charged with simple assault and two summary counts of harassment and one of disorderly conduct for an incident on Sept. 24 at 12:22 p.m.

Police responded to the 400 block of Hazle Street for a disturbance involving a woman and a baseball bat.

On scene officers spoke with Martinez, who said a man and woman were harassing an elderly woman across the street from her and she went over to defend the woman. She never mentioned a baseball bat or if the incident got physical. She told officers she didn’t know the names of the two, except the man’s first name might by Corey.

Police then spoke to the elderly woman who had called police and mentioned the baseball bat.

She said she saw a young man “shaking” a stop sign and yelled at him to stop.

This was what caused the original altercation. She said words were exchanged between her and the man when Martinez arrived with a baseball bat.

The officer then went to Arlington Street where he knew of a resident whose first name was Corey.

He met Corey and his wife outside the home and he did admit there was an argument with the elderly woman which led to Martinez swinging a baseball bat at him.

He said he was not struck by the bat because he was able to grab it from Martinez. He said Martinez hit him in the face three times with a closed fist and also scratched his neck.

His wife also was punched in the face by Martinez, which caused a chipped tooth, he said. Police said the man did have neck scratches and a swollen face.

As a result charges were filed against Martinez.
