Carbon County court — ARD

Thirteen defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Friday by Judge Joseph J. Matika.

If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

Twelve of the 13 cases involved driving under the influence charges. All were placed for a year.

DUI cases

Daniel J. Smith, 53, of Weissport, was arrested on May 18 by state police at Lehighton for DUI of a controlled substance along Bankway in Lehighton.

He was assessed $600 for the cost of the program and ordered to render 50 hours of community service and his license was suspended for 60 days.

Jessica L. Yeakel, 40, of Jim Thorpe, was arrested on April 8 by Jim Thorpe police along Second Street. She refused a test.

She was assessed $600 and ordered to render 50 hours of community service and her license was suspended for 60 days.

Matthew Lee Davison, 23, of Walnutport, was arrested on May 8, by state police at Lehighton along Blue Mountain Drive in Lower Towamensing Township. A test revealed a 0.17 BAC.

He was assessed $550 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Nicholas Walter Lobach, 22, of Palmerton, was arrested on March 7 by state police at Lehighton along Alley G in Lehighton. A test revealed a 0.12 BAC.

He was assessed $550 and ordered to render 50 hours of community service and his license was suspended for 30 days.

Jayendrakumar Patel, 50, of Allentown, was arrested on May 3 by Franklin Township police along Overlook Drive. A test revealed a 0.18 BAC.

He was assessed $550 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Carlee Allen Young, 19, of Emmaus, was arrested on Jan. 17 by state police at Lehighton along Lizard Creek Road in East Penn Township for DUI of a controlled substance.

She was assessed $650 and ordered to render 50 hours of community service and her license was suspended for 90 days.

Stacy A. Decarlo, 34, of Summit Hill, was arrested on March 11 by state police at Lehighton along Lizard Creek Road in East Penn Township for DUI of a controlled substance.

She was assessed $600 and ordered to render 50 hours of community service and her license was suspended for 60 days.

Zachary James Gallagher, 22, of McAdoo, was arrested on April 3 by Weatherly police along Plane Street. A test revealed a 0.12 BAC.

He was assessed $500 and ordered to render 50 hours of community service and his license was suspended for 30 days.

Stone Steven Klotz, 19, of Lehighton, was arrested on May 4 by state police at Lehighton along East Lizard Creek Road in East Penn Township. A test revealed a 0.08 BAC.

He was assessed $450 and ordered to render 50 hours of community service and his license was suspended for 90 days.

Frankie Orlando Diaz, 39, of Hazleton, was arrested on May 23 by state police at Fern Ridge along Interstate 80 in Kidder Township.

He was assessed $550 and ordered to render 50 hours of community service and his license was suspended for 30 days.

George Ogando, 22, of Allentown, was arrested on March 14 by state police at Lehighton along Forge Street in Lehighton, for DUI of a controlled substance.

He was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Sheila M. Spadt, 48, of Walnutport, was arrested on July 29, 2020, by state police at Lehighton, for DUI of a controlled substance along Route 248 at Palmerton.

She was assessed $600 and ordered to render 50 hours of community service and her license was suspended for 60 days.

Retail theft

Gabrielle Kaylee Olson, 21, of Palmerton, was placed for six months on a retail theft charge. She was arrested on Oct. 10, 2020, by Mahoning Township police at the Walmart store. She had two backpacks filled with various items worth $297.94 when she left the store without paying for the items. All the items were recovered.

She was assessed $450, ordered to render 25 hours of community service and stay out of the store for the period of the program.

Each defendant must also pay court costs of over $1,000 and a $50 per month supervision fee while in the program.
