Tamaqua man heads to court in Missouri homicide case

A Tamaqua man charged with murder in Missouri has a June 21 plea/trial setting scheduled.

Missouri court documents show Josue Martinez, 20, has a 1 p.m. court date for a setting or disposition in front of Circuit Court Judge John Beger in the Phelps County Courthouse Rolla, Missouri.

A waiver of arraignment was done June 9 where he entered a not guilty plea.

Kimberly Riston, 29, of Banning, California, his girlfriend, waived her formal arraignment June 1 where she pleaded not guilty. A new court date on the homicide charges she faces has not yet been set.

They are charged with first-degree murder, armed criminal action, robbery and tampering with a motor vehicle. Each is represented by a public defender.

Both remain in the Phelps County Jail without bond.

A probable cause statement filed by a detective with the Phelps County Sheriff’s Department details what police say took place April 21 when Martinez stabbed Donald Wethy, 36, of St. James, Missouri, and left his body in the parking lot of the Economy Inn, 102 N. Outer Road, St. James.
