Hearing canceled for Tamaqua man accused in Mo. stabbing

The hearing for the Tamaqua man and his girlfriend charged in the killing of a man in Missouri is canceled.

A reason is not provided; however, Missouri court documents show a request for a new judge, which was granted. Judge Douglas Don Gaston will conduct the arraignment 9 a.m. June 16 in the Phelps County Courthouse in Rolla, Missouri. A 9 a.m. hearing Tuesday had been scheduled before Judge Kenneth Gordon Clayton.

Josue Martinez, 20, and Kimberly D. Riston, 29, of Banning, California, are each charged with first-degree murder, armed criminal action, robbery and tampering with a motor vehicle. Each is represented by a public defender. Both remain in the Phelps County Jail without bond.

A probable cause statement filed by a detective with the Phelps County Sheriff’s Department details what police say took place April 21 when Martinez stabbed Donald Wethy, 36, of St. James, Missouri, and left his body in the parking lot of the Economy Inn, 102 N. Outer Road, St. James.
