Carbon County court — ARD

A total of 10 defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program during court sessions this week conducted by the county judges.

If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

Judge Nanovic

The following were placed by President Judge Roger N. Nanovic:

Pierce Addison Zechman, 22, of Saylorsburg, was placed for a year on a charge of possession of a controlled substance-methamphetamine. He was arrested on March 9, 2020, by Mahoning Township police along Upper Nis Hollow Road.

He was assessed $450 for the cost of the program and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and zero tolerance imposed for drug or alcohol use.

Joshua Wade Hineline, 30, of Nesquehoning, was placed for a year on a charge of criminal mischief. He was arrested on Oct. 24, 2020, by Nesquehoning police for causing damages to a vehicle.

He was assessed $450 and ordered to get a mental health evaluation and follow any recommendation for treatment and make total restitution of $1,502.59 to the victim.

Holly Lynn Faust, 38, of Nesquehoning, was placed for a year on a charge of possession of a controlled substance-methamphetamine. She was arrested on Dec. 3, 2020, by Nesquehoning police along Industrial Road.

She was assessed $650 and ordered to get a drug and alcohol evaluation and zero tolerance for drug or alcohol use.

Kristian Fritzinger, 23, of Lehighton, was placed for two years on a charge of endangering the welfare of a child. She was arrested on May 28, 2020, by Nesquehoning police at a residence along West Mill Street. Police found drugs in the home and two children, ages 1 and 4, in the home near the drugs.

She was assessed $650 and ordered to get a drug and alcohol evaluation.

Wendy Ann Galicia-Martinez, 30, of Shamokin, was placed for two years a charge of possession with intent to deliver a controlled substance-fentanyl. She was arrested as part of an ongoing investigation by Jim Thorpe police and the county drug task force.

She was assessed $450 and ordered to get a drug and alcohol evaluation.

Judge Serfass

Placed by Judge Steven R. Serfass was:

Juan A. Abreu, 42, of Wilkes-Barre, on a charge of terroristic threats. He was arrested on Nov. 20, 2020, by state police at Fern Ridge when he was involved in a disturbance at the home of his brother in Penn Forest Township, in which he had threatened to kill his brother and caused extensive damages to the residence. His ARD hearing was held via video conference from the county prison where he has been an inmate since the day of the incident.

He was assessed $450 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, attend and successfully complete an anger management course, make restitution of $26,848.10 for damages to the home, render 100 hours of community service and have no contact with his brother.

Judge Matika

Placed by Judge Joseph J. Matika were:

Jacob Hockenberry, 19, of Trucksville, Luzerne County, was placed for 18 months on a charge of aggravated assault, attempt to cause or cause bodily injuries.

Before the placement, Matika said he was reluctant to place him in the program because of the charges. Defense counsel Paul J. Levy said since the incident, Hockenberry has addressed an alcohol abuse problem by getting counseling and enrolling in programs. He also said the police officer who was the victim of the incident agreed to the ARD placement.

Matika approved it and ordered the defendant to pay an assessment of $450, render 75 hours of community service, get a mental health evaluation and attend and successfully complete an anger management course.

Joseph Dane Nothstein, 19, of Effort, was placed for six months on a charge of possession of a small amount of marijuana. He was arrested on Nov. 29, 2019, by state police at Lehighton following a traffic stop along Route 209 in Towamensing Township.

He was assessed $450 and ordered to render 25 hours of community service.

Dimen Angel Burgos, 25, of Weatherly, was placed for six months on a charge of possession of marijuana. She was arrested on Nov. 17, 2020, by Weatherly police along East Main Street.

She was assessed $450 and ordered to render 25 hours of community service.

Jennifer Diaz, 38, of Glen Lyon, Luzerne County, was placed for six months on a charge of possession of marijuana. She was arrested on Oct. 14, 2020, by Weatherly police along Hudsondale Street.

She was assessed $450 and ordered to render 25 hours of community service.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
