Man charged with threatening to kill wife, resists arrest
A Kunkletown man has been charged with threatening to kill his wife and resisting arrest.
According to the affidavit of probable cause filed by Pennsylvania State Police Trooper Justin Swartz, Lehighton barracks, in the case against Timothy Chuss, 32:
Swartz responded at 10:28 p.m. Feb. 22 to an incident in the 1000 block of Hideaway Hill Road, Polk Township, on a call for an active domestic.
Swartz saw a shirtless man open and quickly close the front door.
Swartz knocked on the door and another man answered who said the domestic was between his roommates who are married and also live inside the residence.
The man directed Swartz to a back bedroom where he heard items getting smashed/slammed. He said there were firearms in the residence, but they were secured and away from Chuss.
Swartz then made contact with Chuss, who became belligerent and began to scream and yell.
Chuss became more aggressive, was detained and began to resist arrest by tucking his arms under his body and pulling away from troopers. He was detained again and secured in a state police unit.
Swartz interviewed the man who Chuss and his wife lived with, and the man said that Chuss was drinking heavily and has been for a while.
The man added that Chuss began to yell and started to break things in the residence and yelled, “I’m going to kill the (expletive),” referring to his wife.
The roommate said Chuss tried to go to his wife’s room and he restrained him.
He told police he restrained Chuss because the day prior, Chuss struck his wife in the face, and the man didn’t want anything to happen again.
Chuss’ wife said she had a domestic incident the day before when he struck her in the face and said he wanted to kill himself.
While Chuss was in the patrol vehicle, he began to kick the passenger side rear window.
Chuss faces charges of terroristic threats with intent to terrorize another; resisting arrest/other law enforcement; disorderly conduct - hazardous/physically offensive; and criminal mischief - deception/threat.
He is incarcerated in the Monroe County Correctional Facility in lieu of $50,000 monetary bail and scheduled to have a preliminary hearing March 12 before District Judge Colleen Mancuso of Brodheadsville.
