Carbon County court — guilty pleas

A Nesquehoning man admitted his part in a robbery at a store he was employed at in Carbon County court on Thursday.

He was one of seven defendants in pending criminal cases to enter a guilty plea before Judge Joseph J. Matika.

Nesquehoning incident

Kyle Lee Tetreault, 24, pleaded to one count of criminal conspiracy, receiving stolen property. He was arrested for an incident on Dec. 3, 2016, at the Turkey Hill Mini Market along Catawissa Street in Nesquehoning. Police said while Tetreault was working as a clerk at the store, Coty Frank entered to rob it.

Frank pleaded guilty to his part in the incident and told police that Tetreault recognized him during the course of the theft, but that the clerk let him go through with the robbery because Frank agreed to pay him off. Tetreault was originally charged with seven criminal counts and was placed in the Accelerated Rehabilitation Disposition probation program for first-time offenders but was revoked from it for violating conditions.

Matika placed him on probation for six months and ordered him to make restitution of $457.52 to Turkey Hill, render 25 hours of community service and to stay out of the store.

Retail thefts

The following defendants pleaded to retail theft charges.

Manuel Antonio Rivera Jr., 24, of Allentown, pleaded to two counts of retail theft for two incidents in Mahoning Township, both on Feb. 8, 2017 - one at the Walmart store and the second at the Giant Market.

Matika place him on probation for a year on each count, running concurrent to each other, and ordered he render 50 hours of community service, supply a DNA sample and make restitution of $569.14 to Walmart and $111.52 to Giant and stay out of both stores.

He entered his pleas via video conference from the Lehigh County prison where he is serving a probation violation sentence.

Darlene Marie Miller, 56, of Summit Hill, was arrested at the Walmart store on March 11, 2020.

She was placed on probation for a year and ordered to render 25 hours of community service, supply a DNA sample and make restitution of $25.08.

Todd David Radier, 56, of Palmerton, was arrested at the Walmart store on July 20, 2020.

He was placed on probation for a year and ordered to render 50 hours of community service, supply a DNA sample and stay out of the store. There was no restitution as the stolen items were recovered.

Joseph P. Daignault, 37, of Walnutport, was arrested at the Walmart store on Sept. 4, 2020.

He was placed on probation for a year and ordered to render 50 hours of community service, supply a DNA sample and stay out of the store. There is no restitution as the stolen items were recovered.

Keith Richard Pettis, 33, of Lansford, was arrested at the Penn Mart store along Patterson Street by Lansford police on Aug. 17, 2020.

He was placed on probation for a year and ordered to render 50 hours of community service, get a drug and alcohol evaluation and follow any recommendation for treatment, supply a DNA sample and stay out the store. No restitution was requested from the victim.

The term runs consecutive to a probation period he is currently serving in Schuylkill County.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation.
