Carbon County court — guilty pleas

A total of 24 defendants in pending criminal cases entered guilty pleas in Carbon County court on Monday during a daylong court session.

Judge Steven R. Serfass accepted pleas from the following:

Nesquehoning incident

Paula Nicole Creveling, 31, of Lansford, pleaded to one count of reckless endangering of another person.

She was arrested by Nesquehoning police on Jan. 23, 2020, outside Redner’s Warehouse Market. Police responded to the area for a report of two children left alone in a running vehicle. In exchange for the plea the district attorney’s office dropped two counts of endangering the welfare of a child.

District Attorney Michael S. Greek said he agreed to the deal because the children were alone for only about 10 minutes. It was also noted one of the children was killed on June 3 when struck by a vehicle in Lansford.

Creveling received counseling for the loss of the child.

Serfass said a probation period was “appropriate” considering all the circumstances.

He placed Creveling on probation for 18 months and ordered her to render 75 hours of community service.

Lansford incidents

Deanna Augelli, 42, of Lansford, pleaded guilty in two pending cases to two counts of persistent disorderly conduct.

She was arrested on Oct. 11 and 13, 2020, by Lansford police for incidents along East Kline Avenue. She was reportedly riding back and forth at a residence, blowing the horn on her vehicle in one case and then causing a disturbance at the same residence in the second case.

She admitted to the court she should have handled the situation differently. The target of the conduct was a man who resides at the residence.

Serfass placed her on probation for six months on each count with the terms running consecutively. She was also ordered to get a mental health evaluation and follow any recommendation for treatment.

Assault case

Aric Tyle Fox, 21, of Bethlehem, formerly of Summit Hill, pleaded to one count of simple assault. In exchange for the plea a felony 1 count of aggravated assault was dropped in a plea deal.

He was arrested on Aug. 11, 2019, by Mahoning Township police for an incident at a party at a township home. A total of four people were charged in the incident.

According to police the victims, a 15-year-old teen and his brother, were injured during the assault and had to be treated at the Lehigh Valley Hospital, Cedar Crest. One of the victims was treated in the St. Luke’s Lehighton Campus Emergency Room for second-degree burns to the back of his right leg from above his knee to his ankle before being transferred to LVH. The other victim required surgery to wire his jaw shut and also needed stitches in the back of his head to close a laceration.

Charged with Fox were Lucas Mika,Alexander Candelario, 19, and Justin Rodriguez, 19, both of Lansford, involved in the assault.

Serfass deferred sentencing due to a question concerning the amount of restitution due for medical bills.

Other cases

Zachary P. Chandler, 34, of Waterbury, Connecticut, previously pleaded to one count of criminal conspiracy - retail theft and accidents involving damage to unattended property. In exchange for the plea the DA’s office agreed to drop four felony 1 counts.

He was arrested by Mahoning Township police for an incident at the Verizon store along Route 443 when Chandler and another man stole multiple items from the store. He fled in a vehicle and struck parked cars in the parking area as he fled.

The case has 22 continuances in it due to the fact that part of the plea bargain was that Chandler testify against his co-defendant at any trial held. However, the co-defendant still has not been found.

Serfass sentenced him to serve three to one day less 24 months in prison on both counts with the terms running concurrently. He was also ordered to supply a DNA sample, render a total of 150 hours of community service when paroled and testify against the co-defendant. He will began the jail term at 9 a.m. on Feb. 8.

Todd M. Messinger,Tito Rodriguez, 26, of Lehighton, pleaded to one count of resisting arrest. In exchange for the plea 11 counts were dropped, including to felony aggravated assault charge in a plea deal.

He was arrested on Oct. 19, 2014, by Nesquehoning police when stopped along Route 93 for speeding, 76 mph in a 55 zone. Police conducted a search and found crack cocaine on his person and a large amount of cash. While police continued to investigate the vehicle Rodriguez fled into near by woods. He was not found for a period of time. A warrant was put out for his arrest and he was eventually apprehended.

Serfass sentenced him to time-served (13 days) to one year in jail and ordered he get a drug and alcohol evaluation and render 50 hours of community service.

Kenneth George Ahner, 49, of Lehighton, pleaded to one count of possession of a controlled substance, methamphetamine. He was arrested on Dec. 4, 2019, by Lehighton police following a vehicle stop near the Weissport bridge. A driving under the influence charge was dropped in a plea deal with the DA.

He was placed on probation for six months and ordered to pay a fine of $300, get a drug and alcohol evaluation and render 50 hours of community service.

Debra J. Weed, 61, of Allentown, pleaded to one count of unsworn falsification to law enforcement for an incident on Dec. 28, 2019, in Jim Thorpe.

She was charged for an incident in which she used another person/or signed the name of another person in a criminal matter.

She was sentenced to time-served (nine days) to one year in prison and ordered to render 50 hours of community service.

David Eisenhower, 40, of Lehighton, entered pleas in two pending cases. He pleaded to two counts of harassment for incidents on Feb. 18, 2016, and May 12, 2018, both filed by Lehighton police involving assault charges involving two different female victims. In the two cases felony counts of aggravated assault were dropped in plea deals with the DA’s office.

On the first count Serfass sentenced him to served 45 to 90 days, with credit for 90 days served and on the second case a fine of $300.

Daniel Melvin Walderon, 38, of Weissport, pleaded to one count each of simple assault and obstructing the administration of law. He was charged for an incident on Jan. 30, 2020, in Weissport. In exchange for the pleas charges of flight to avoid apprehension, a felony 3, simple assault and resisting arrest were dropped in a plea deal.

Serfass sentenced him to serve six to one day less 24 months in jail on each count, with the terms running concurrently. He was also ordered to get both drug and alcohol and mental health evaluations, zero tolerance for drug or alcohol use and render a total of 200 hours of community service.

He was given credit for four days already served.

Walderon is currently an inmate in the county prison and his pleas were done via video conference from the prison. He is in jail on a parole violation.

Anthony Gabriel Felix, 34, of East Stroudsburg, pleaded to one count of simple assault. In exchange of the plea a felony 1 count of aggravated assault was dropped in a plea deal.

He was arrested on Nov. 4, 2016, by Kidder Township police for an altercation involving another man. Both parties sustained injuries in the incident, it was noted.

Serfass sentenced him to time-served (eight days) to 18 months in prison and ordered he supply a DNA sample, render 75 hours of community service and have no contact with the victim.

Kendall Joy Lawless, 20, of White Haven, was sentenced to serve five days to six months in jail on a DUI charge she previously pleaded guilty to. She was also ordered to pay a fine of $300, one-year license suspension and render 25 hours of community service. She was given credit for 28 days spent in an inpatient rehabilitation program and paroled.

She was arrested on Nov. 5, 2018, by Weatherly police along Main Street. A test revealed a 0.04 BAC.

Greg Crostley, 50, of Lehighton, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service on a DUI count he previously pleaded to.

He was arrested for DUI of a controlled substance on Jan. 16, 2020, by Lehighton police along Route 443.

He will begin the jail term at 9 a.m. on Feb. 8.

William J. Hamby, 50, of Slatington, was sentenced to serve five days to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service. He was given credit for three days already served and will begin serving the remaining two days on Feb. 8 at 9 a.m.

He arrested on Oct. 21, 2017, at Route 443 and Ninth Street by Lehighton police. A test revealed a 0.16 BAC.

Lori Bobarsky, 54, of Jim Thorpe, pleaded to one count of possession of marijuana. She was arrested on July 11, 2019, by Nesquehoning police when police responded to a woman acting strangely. A charge of possession of a controlled substance was dropped in a plea deal.

She was fined $300.

Byron Dale Schnell, 68, of Lehighton, pleaded to one count of DUI. He was arrested on Dec. 27, 2019, by state police at Lehighton along Route 209. A test revealed a 0.09 BAC.

A first offense, he was placed on probation for six months and ordered to pay a fine of $300.

Matthew Joel Castellaneta, 38, of Coaldale, pleaded to one count of disorderly conduct. He was arrested on May 18, 2020, by Lansford police following a vehicle stop along West Patterson Street.

He was fined $300.

Emily J. James, 36, of Bucksport, Maine, pleaded to one count of loitering or prowling at night. In exchange for the plea a felony count of criminal trespass was dropped in a plea deal.

She was arrested on Nov. 22, 2019, by Nesquehoning police, who responded to a residence for a report of an intoxicated female. Police said the incident was part of a child custody matter.

Serfass imposed a fined of $2,500. Her plea was done via Zoom from her home in Maine.

Arthur Scott Hanman,Shawn Neff,Deborah M. Coombs, 30, of Lansford, pleaded to one count of obstruction the administration of law. In exchange for the plea charges of simple assault and resisting arrest were dropped.

She was arrested on Aug. 24, 2020, by Lansford police for an incident along East Abbott Street. Police responded to a disturbance and found Coombs involved. When police attempted to take a man at the scene into custody Coombs interfered.

Serfass sentenced her to serve three to 18 months in prison and ordered her to get a mental health evaluation and render 75 hours of community service.

She will begin the jail term at 9 a.m. on Feb. 12 and serve it on consecutive two-day weekends.

Christopher R. Deans, 35, of Tamaqua, pleaded to one count each of DUI and recklessly endangering another person. In exchange for the plea a felony count of fleeing or attempting to elude police was dropped in a plea deal.

He was arrested on Nov. 3, 2019, by Palmerton police along Route 248 when he was clocked going 100 mph eastbound in a 55 zone.

Sentencing was deferred.

Jeffrey Espinal, 25, of Palmerton, pleaded to one count of DUI of a controlled substance. He was arrested on Sept. 3, 2018, by Palmerton police.

Sentencing was deferred so Espinal can apply for the house arrest program.

Tiana Miceli, 26, of Lansford, pleaded to one count of possession of drug paraphernalia. She was arrested on July 2, 2019, by Nesquehoning police following a vehicle stop.

She was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service. The probation period is concurrent with a probation she is currently serving.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
