Carbon County court — guilty pleas

Six defendants in pending criminal cases entered guilty pleas in Carbon County court on Thursday.

Judge Joseph J. Matika accepted the pleas from the following:

Resisting arrest

Wilbur Louis Fountain Jr., 45, of Palmerton, entered pleas in two pending cases to resisting arrest and accidents involving damages to attended vehicle/property.

He was arrested on the resisting charge on Oct. 27, 2020, by Palmerton police at a residence along Lehigh Avenue. Police responded to the area for a report of a disturbance involving Fountain. When police attempted to take him into custody he struggled with the officers.

The second count occurred on Oct. 7 in Palmerton. Fountain was riding a bicycle when the bike struck a vehicle along Avenue A, then he left the scene. He was later located and charged.

Fountain entered his pleas from the county prison via video where he is serving a probation violation sentence which runs to March 23.

On the resisting count Matika sentenced him to serve three to 18 months in jail and on the accidents count one year probation with the terms running concurrent to each other and concurrent to his probation sentence. He was also ordered to get a mental health evaluation and follow any recommendation for treatment and render 75 hours of community service.

Other pleas

Chance Michael Whiteman, 20, of Lehighton, pleaded to one count of receiving stolen property, as a felony 3. He was charged with stealing the 2001 Saturn vehicle of a Palmerton resident on Oct. 13, 2020. The victim had entered a business along Lehigh Avenue and left the keys in the vehicle. Whiteman stole the car, which was later recovered.

Whiteman entered his plea from the county prison where he is being held on the charge.

Matika sentenced him to serve three to 18 months in prison with credit for 95 days already served, and paroled.

He was also ordered to get a drug and alcohol evaluation, supply a DNA sample, render 50 hours of community service and have no contact with the victim.

Dawn Willis, 42, of Summit Hill, pleaded to one count each of resisting arrest and defiant trespass. She was arrested on Nov. 9, 2020, by Palmerton police. Police responded to a laundromat in the 600 block of Delaware Avenue for an unruly female. Willis was causing a disturbance, was told to leave but refused and struggled with the officers.

Matika placed her on probation for a year on each count, running concurrently, and ordered her to get a mental health evaluation, render 50 hours of community service and stay off the property.

Ronald James Dugon Jr., 25, of Weatherly, pleaded to one count of simple assault. He was arrested on Nov. 5, 2020, when Weatherly police were dispatched to a residence along North Street for a domestic incident. Dugon was involved in an altercation with his girlfriend. A felony 2 count of strangulation was dropped in a plea deal with the district attorney’s office.

Matika placed him on probation for a year and ordered him to get both drug and alcohol and mental health evaluations and supply a DNA sample.

Shelby Pavlick, 27, of Hazleton, pleaded to one count of false identification to law enforcement. She was arrested on Nov. 21, 2020, by Weatherly police following a traffic stop along Plane Street. She was a passenger in the vehicle and gave a false name. She claimed she gave the false name because she was afraid there was a warrant out for her arrest for unpaid fines.

Matika noted it was her fourth conviction for false ID.

He placed her on probation for a year and ordered her to get a D&A evaluation and render 50 hours of community service work.

Daniel Valerio, 26, of Hazleton, pleaded to one count of driving under the influence of a controlled substance. He was stopped on June 13, 2017, along Interstate 80 in Kidder Township by state police at Fern Ridge.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee if on parole/probation.

ARD

Robert Edwin McNabb, 42, of Allentown, was placed in the Accelerated Rehabilitation Disposition probation program for a year on a simple assault charge. He was arrested by state police at Lehighton on Oct. 18, 2020, at his then residence in Parryville, following a domestic dispute with his girlfriend.

He was also ordered to pay $450 for the cost of the program, get a drug and alcohol evaluation, render 50 hours of community service, pay court costs of about $1,000 and pay a $50 per month supervision fee while in the program.

If he successfully completes all conditions of the program, his record will be wiped clean. However, if he fails to complete the program, or is revoked from it, then he would face trial on the charge. He did not admit guilt in entering the program.
